Jani for the respondent no.1-State and learned<br \/>\n\tcounsel, Mr.P.A. Bhatt for the respondent no.2-original complainant<br \/>\n\twaive service of notice of rule.\n<\/p>\n<p>The<br \/>\n\tpresent application has been filed by the applicant under Articles<br \/>\n\t14, 19, 226 and 227 of the Constitution<br \/>\n\tof India as well as under Section 482 of the Criminal<br \/>\n\tProcedure Code, 1973 for the prayer that FIR being<br \/>\n\tC.R.No.I-15\/2011 registered with Ranip Police Station and the<br \/>\n\tchargesheet filed thereunder may be quashed and set aside on the<br \/>\n\tgrounds mentioned in the application.\n<\/p>\n<p>Heard<br \/>\n\tlearned counsel, Mr.Alpesh Dodia for the applicant, learned A.P.P.,<br \/>\n\tMr.H.L. Jani for the respondent no.1-State of Gujarat and learned<br \/>\n\tcounsel, Mr.P.A. Bhatt for the respondent no.2.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Dodia for the applicant and learned counsel, Mr.Bhatt<br \/>\n\tfor the respondent no.2 have stated that there is cross complaints<br \/>\n\tfiled against each other and now they have arrived at amicable<br \/>\n\tsettlement as it was a trivial dispute over a parking of a vehicle.<br \/>\n\tLearned counsel, Mr.Bhatt has also placed on record an affidavit of<br \/>\n\tthe complainant. Both counsel, therefore, submitted that since the<br \/>\n\tdispute has been amicable settled, FIR and the chargesheet filed<br \/>\n\tthereunder may be quashed and set aside.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances and considering the fact that the<br \/>\n\tdispute with regard to parking of a vehicle has not been amicably<br \/>\n\tsettled between the parties, the present application deserves to be<br \/>\n\tallowed in light of the observations made by the Hon&#8217;ble Apex Court<br \/>\n\tin a judgment in case of Madan Mohan Abbot V\/s State of Punjab<br \/>\n\treported in (2008) 4 SCC 582 that<br \/>\n\tthe approach should be pragmatic based on ground realities.\n<\/p>\n<p>In<br \/>\n\tthe circumstances, the present application stands allowed in terms<br \/>\n\tof Para No.10(A). The impugned FIR being C.R.No.I-15\/2011 registered<br \/>\n\twith Ranip Police Station and the chargesheet filed thereunder are<br \/>\n\thereby quashed and set aside.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
