P5 and P6 orders of assessment for<\/p>\n<p>the years 2001-02 and 2002-03 petitioner filed appeals<\/p>\n<p>as is evident from Exts. P7 and P8.     Considering the<\/p>\n<p>application made by the petitioner for stay of recovery<\/p>\n<p>of tax due in terms of the orders of assessment, the<\/p>\n<p>appellate authority has passed Ext. P9 order granting<\/p>\n<p>stay on condition that the petitioner remits 50% of the<\/p>\n<p>tax.  This order has not been complied with and that<\/p>\n<p>resulted in Ext. P10 revenue recovery notice, by which,<\/p>\n<p>the entire dues in terms of the orders of assessment<\/p>\n<p>are sought to be recovered.     It is challenging the<\/p>\n<p>revenue recovery proceedings as also the conditional<\/p>\n<p>order of stay which  has been granted by the appellate<\/p>\n<p>authority that this writ petition has been filed.<\/p>\n<p>    2. In so far as Ext. P9 conditional interim order<\/p>\n<p>of stay passed by the appellate authority is concerned,<\/p>\n<p>the petitioner has not complied with the same.    Since<\/p>\n<p>the petitioner has not complied with the conditions<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 30891 OF 2007            -2-<\/span><\/p>\n<p>imposed by the appellate authority in Ext. P9, and<\/p>\n<p>since stay obtained from the appellate authority stands<\/p>\n<p>vacated, the respondents cannot be faulted for the<\/p>\n<p>steps they have taken by Ext. P10 revenue recovery<\/p>\n<p>notice.\n<\/p>\n<p>     3. As far as the condition imposed for requiring<\/p>\n<p>the petitioner to remit 50% of the tax due as per Ext.<\/p>\n<p>P9 is concerned, the contention raised by the learned<\/p>\n<p>counsel for the petitioner is that the quantification<\/p>\n<p>of tax is based only on the details of the energy<\/p>\n<p>charges collected by the Electricity Board and that<\/p>\n<p>this has been done despite the labour unrest and<\/p>\n<p>consequential suspension of work, that was prevailing<\/p>\n<p>in the unit.\n<\/p>\n<p>     4. These aspects have already been dealt with in<\/p>\n<p>Exts. P5 and P6 assessment orders.       In any case this is<\/p>\n<p>a matter to be gone into by the appellate authority.<\/p>\n<p>Having gone through the order Ext. P9, I am not in a<\/p>\n<p>position to find any perversity in the order passed by<\/p>\n<p>the appellate authority.\n<\/p>\n<p>     5. Therefore, I am not in a position to interfere<\/p>\n<p>with Ext. P10.          However, as a last chance  I direct<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 30891 OF 2007          -3-<\/span><\/p>\n<p>that if the petitioner remits the amount ordered in<\/p>\n<p>Ext.
