              The   writ   petitioners   are   the   employees   of   the<\/p>\n
second respondent, bank.   There were allegations of mis-<\/p>\n
appropriation and mis-conduct, during their service.  They<\/p>\n
were   proceeded   against,   as   per   the   service   rules.     The<\/p>\n
allegations   made   against   them   were   found   to   be   proved.<\/p>\n
Therefore,   the   punishment,     as   prescribed   under   the<\/p>\n
Kerala       Co-operative Societies Rules, 1969, in short ‘the<\/p>\n
Rules’, had been imposed.  However, a vigilance  case had<\/p>\n
been registered   against  three  persons,  including   the  writ<\/p>\n
petitioners   herein.     The   Vigilance   and   Anti   corruption<\/p>\n
Bureau   had   continued   with   the   investigation.               On<\/p>\n
collection of the materials,   F.I.R   had been lodged under<\/p>\n
Sections   13(2)   and   13(1)(c)   of   the   Prevention   of<\/p>\n
Corruption   Act,   1984,   and   also   under   Sections   109,   465,<\/p>\n
467, 468, 471, 477A, 201 and 120B of IPC.<\/p>\n
      2.      On   receiving   the   information   from   Vigilance<\/p>\n
W.P.(C).33288\/2006<\/p>\n
                                    2<\/span><\/p>\n
and   Anti   Corruption   Bureau,   the   first   respondent,     the<\/p>\n
Joint   Registrar   of   Co-operative   Societies,   through   his<\/p>\n
communication   dated   28.11.2006,   had   addressed   the<\/p>\n
second   respondent   to   place   the   writ   petitioners   under<\/p>\n
suspension,  as their continuance in service would affect<\/p>\n
the further investigation of the criminal case.<\/p>\n
      3.     Basing   on   the   communication   of   the   first<\/p>\n
respondent,  the second respondent issued a show cause<\/p>\n
notice   to   the   writ   petitioners,   directing   them   to   show<\/p>\n
cause   why   they   should   not   be   suspended   from   service.<\/p>\n
Accordingly,   both   the   writ   petitioners   had   filed   their<\/p>\n
replies.     The   same   are   thus   under   consideration   of   the<\/p>\n
second   respondent.     While   so,   the   petitioners   came   up<\/p>\n
before   this   Court,   praying   that,   as   a   domestic   enquiry<\/p>\n
had   already   been   completed   and   penalties   imposed,<\/p>\n
according   to   the   Rules,     there   should   not   be   a   further<\/p>\n
suspension,  which would affect their very existence and<\/p>\n
their family members also would be put into difficulties.<\/p>\n
      4.     The   learned   counsel   for   the   writ   petitioners<\/p>\n

                                     3<\/span><\/p>\n
submitted, relying on  Muhammed Kutty  v.  Secretary<\/a><\/p>\n
to Government (2002  (1)  KLT  880), to emphasis the<\/p>\n
point   that   the   Joint   Registrar   has   got   no   authority   to<\/p>\n
direct   the   second   respondent,   bank,   to   suspend   their<\/p>\n
employees.     The   counsel   also   relied   on    Gopinathan<\/p>\n
Nair  v.  Registrar of Co-operative Societies<\/a>   (1978<\/p>\n
KLT  392) to argue that,  discretion has to be exercised<\/p>\n
by   an   authority   invested   with     such   discretion   and   law<\/p>\n
has to be exercised uninfluenced by the directions of any<\/p>\n
extraneous authority.   The counsel, therefore, submitted<\/p>\n
that   the   first   respondent   had   got   no   authority   to   direct<\/p>\n
the second respondent to suspend the writ petitioners.<\/p>\n
      5.     The learned Government Pleader, on the other<\/p>\n
hand,   submits   relying   on  State   of   Rajasthan     v.<\/p>\n
B.K.Meena   and   Others<\/a>     (1996    (6)     SCC       417)   to<\/p>\n
argue   that     “disciplinary   proceedings   are   meant   not<\/p>\n
really to punish the guilty, but to keep the administrative<\/p>\n
machinery unsullied by getting rid of bad elements”.  On<\/p>\n

the other hand,  criminal proceedings are initiated to see<\/p>\n
whether   the   accused   had   committed   any   offence   as<\/p>\n
alleged   against   them.     The   Government   Pleader   also<\/p>\n
placed   reliance  on    Depot   Manager,   A.P.   State   Road<\/p>\n
Transport   Corporation     v.     Mohd.   Yousuf     Miya<\/a><\/p>\n
(1997   (2)     SCC     699)  to   reiterate   the   point   that   the<\/p>\n
purpose of departmental enquiry and of  prosecution are<\/p>\n
too   different   and   distinct   aspects.          The   criminal<\/p>\n
prosecution is lodged for an offence, for the violation of a<\/p>\n
duty,   which   the   offender   owes   to   the   society.<\/p>\n
Departmental   enquiry   is   to   maintain   discipline   in   the<\/p>\n
service   and   efficiency   of   public   service.     Both   the<\/p>\n
proceedings are distinct and different.<\/p>\n
      6.     The   above   legal   principles   clearly   show   that<\/p>\n
there   can   be   criminal   proceedings   as   well   as<\/p>\n
departmental enquiries.  In the case at hand,  the plea of<\/p>\n
the writ   petitioners is that the allegations made against<\/p>\n
them   had   been   found   proved   and,   therefore,   the<\/p>\n
punishments,   as   prescribed   under   the   Rules,   had   been<\/p>\n

impose on them.   Hence, the suspension at the instance<\/p>\n
of the first respondent, need not be again imposed.<\/p>\n
       7.     As   discussed   above,     the   show   cause   notice<\/p>\n
had   been   issued   and   the   replies   furnished   by   both   the<\/p>\n
writ petitioners.  The final decision  has to come from the<\/p>\n
second respondent, the Co-operative bank.<\/p>\n
       8.     In   the   above   legal   and   factual   situation,   the<\/p>\n
second   respondent   shall   take   an   independent   decision,<\/p>\n
uninfluenced by the directions of the first respondent to<\/p>\n
suspend them.  On the suspension of the writ petitioners,<\/p>\n
this Court, at this stage, need not interfere with the show<\/p>\n
cause   notice   issued   by   the   second   respondent   or   the<\/p>\n
replies   furnished   by   the   writ   petitioners.     It   is   for   the<\/p>\n
disciplinary   authority,   the   managing   committee   of   the<\/p>\n
second respondent, to take appropriate decision, in view<\/p>\n
of the legal principles discussed above.  Therefore, I  find<\/p>\n
no further orders are necessary to be given through this<\/p>\n
writ petition.\n<\/p>\n<\/p>\n
       9.     However,   I   make   it     clear   that   the   writ<\/p>\n

                                    6<\/span><\/p>\n
petitioners   will   be   free   to   redress   their   grievance,     if<\/p>\n
their  interests are adversely affected,   in the  order that<\/p>\n
may be  passed by the second respondent.<\/p>\n
             The writ petition is closed  as above.\n<\/p>\n<\/p>\n
