Justice M.SASIDHARAN NAMBIAR\n\n Dated :26\/05\/2009\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          CRL.M.C.No.1685    OF 2009\n          ===========================\n\n      Dated this the 26th day of May,2009\n\n                     ORDER\n<\/pre>\n<p>    Petitioner is the accused in C.P.3\/2009<\/p>\n<p>pending  before   the  Judicial   First   Class<\/p>\n<p>Magistrate  Court-I,   Pathanamthitta.     This<\/p>\n<p>petition  is  filed  for  a  direction  to  the<\/p>\n<p>Magistrate to grant bail on the date of his<\/p>\n<p>surrender.\n<\/p>\n<p>    2.    Learned  counsel  appearing  for  the<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>    3.   The allegation against the petitioner<\/p>\n<p>was that he committed the offence under section<\/p>\n<p>55(g) of the Kerala Abkari Act.    The question<\/p>\n<p>whether petitioner is to be granted bail or not<\/p>\n<p>is to be decided by the concerned Magistrate.<\/p>\n<p>When an absconding accused surrenders and files<\/p>\n<p>an application for bail, the Magistrate is<\/p>\n<p>expected to pass orders in the bail application<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.1685\/2009           2<\/span><\/p>\n<p>without delay.
