The respondent issued an<br \/>\n\tadvertisement in the Daily  Rekheval  on 18th April<br \/>\n\t1998, inviting applicatino for the post of Education Inspector.  In<br \/>\n\tthe said advertisement condition no. 5  was that the true copy of<br \/>\n\tthe mark sheet was to be sent along with the application. The last<br \/>\n\tdate for submission was 4th May 1998.\n<\/p>\n<p>2.2<br \/>\n\t\tThe petitioner had cleared his B.Ed. Examination but did not<br \/>\n\treceive the marksheet and therefore, without waiting further, he<br \/>\n\tsubmitted his application on 2nd May 1998 along with a<br \/>\n\tcertificate obtained from the Principal of the concern College.\n<\/p>\n<p>2.3<br \/>\n\t\tThe petitioner was called for personal interview but was not<br \/>\n\tselected. Therefore he addressed a letter to the respondent<br \/>\n\tauthority. The respondent replied that the petitioner was not<br \/>\n\tselected because he had not submitted the true copy of the mark<br \/>\n\tsheet of B.Ed. before the last date of submission. Though the<br \/>\n\tpetitioner is eligible, he has not been selected. Hence this<br \/>\n\tpetition.\n<\/p>\n<p>\tHeard learned Advocates for<br \/>\n\tthe respective parties and perused the documents on record.\n<\/p>\n<p>\t\tThe respondents had filed<br \/>\n\ttheir reply. In para seven of the said reply they had mentioned that<br \/>\n\t:\n<\/p>\n<p>\t The petitioner is<br \/>\n\tconsidered for the post of Assistant Deputy Educational Inspector<br \/>\n\tthough he had forwarded the marksheet of the qualification of B.Ed.<br \/>\n\tAfter 4th May,1998 then it would be contrary to the terms<br \/>\n\tand conditions laid down in the advertisement and it would also<br \/>\n\tcause irreparable damage to others similarly situated candidates who<br \/>\n\thad forwarded the marksheets or other certificates after 4th<br \/>\n\tMay,1998 and on that ground they are not considered and called for<br \/>\n\tthe interview . It is further stated that there are number of<br \/>\n\tcandidates who had not forwarded such certificates and\/or marksheets<br \/>\n\tafter 4th May 1998 only on the ground that the terms and<br \/>\n\tconditions mentioned in the advertisement were to the effect that<br \/>\n\tsuch  certificates and\/or marksheets would not be considered and<br \/>\n\tappreciated.\n<\/p>\n<p>\t\tIn my view, the Selection<br \/>\n\tCommittee has rightly justified in their decision as the petitioner<br \/>\n\thas not  forwarded the marksheet. The respondent cannot deviate from<br \/>\n\tthe Rules and Regulations. In that view of the matter, petition is<br \/>\n\tbeyond of merits and deserves to be dismissed and the same is<br \/>\n\tdismissed accordingly.
