Heard learned counsel appearing on behalf<\/p>\n<p>                  of     the     petitioner      and     the     learned        counsel<\/p>\n<p>                  appearing on behalf of the State.<\/p>\n<p>                               Petitioner   is      in   custody       in   connection<\/p>\n<p>                  with Jehanabad P.S.Case No.88 of 2006 (Sessions<\/p>\n<p>                  Trial    No.158\/678       of      2006)        for     the    offence<\/p>\n<p>                  punishable under Sections 452, 323, 342, 307 of<\/p>\n<p>                  the Indian Penal Code.\n<\/p>\n<p>                               This is a case of misuse of the privilege<\/p>\n<p>                  of bail the petitioner having been granted bail by<\/p>\n<p>                  a bench of this Court in Cr.Misc.No.50235 of 2006<\/p>\n<p>                  vide order passed on 3.1.2007.\n<\/p>\n<p>                               Learned counsel for the petitioner submits<\/p>\n<p>                  that     in     absence      of    communication          from     the<\/p>\n<p>                  pairwikar that the matter could not be attended to<\/p>\n<p>                  and as a consequence whereof, the bail bond of the<\/p>\n<p>                  petitioner      was    cancelled       on    22.8.2009.       Learned<\/p>\n<p>                  counsel further submits that it is upon his arrest<\/p>\n<p>                  that the petitioner came to know that his bail<\/p>\n<p>                  bond was cancelled. Learned counsel submits that<\/p>\n<p>                  the petitioner undertakes to participate in the<\/p>\n<p>                  trial    on     each   and     every        date     fixed.   It   is<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>      submitted that from a plain reading of the first<\/p>\n<p>      information report, it is clear that there is no<\/p>\n<p>      specific allegation against the petitioner.<\/p>\n<p>              Considering                 the             circumstances            and<\/p>\n<p>      submissions      of        the      learned           counsel,        let    the<\/p>\n<p>      petitioner      Wakil       Yadav         be    released         on   bail    on<\/p>\n<p>      furnishing       bail          bonds           of     Rs.10,000\/-           (ten<\/p>\n<p>      thousand) with two sureties of the like amount<\/p>\n<p>      each    to     the        satisfaction              of     the     Additional<\/p>\n<p>      District Judge, F.T.C.V, Jehanabad in connection<\/p>\n<p>      with Jehanabad P.S.Case No.88 of 2006 (Sessions<\/p>\n<p>      Trial    No.158\/678            of     2006),             subject      to     the<\/p>\n<p>      condition that the petitioner would be attending<\/p>\n<p>      the trial on each and every date fixed in the case<\/p>\n<p>      and    failure       on    the      part       of    the    petitioner       to<\/p>\n<p>      attend the trial on two consecutive dates fixed<\/p>\n<p>      without reasonable explanation to the satisfaction<\/p>\n<p>      of the trial court, would confer liberty                               to the<\/p>\n<p>      trial        court        to        initiate             proceeding          for<\/p>\n<p>      cancellation of his bail bond and for taking him<\/p>\n<p>      into custody.\n<\/p>\n<\/p>\n<pre>ahk                                    (Jyoti Saran, J.)\n<span class=\"hidden_text\"> 3<\/span>\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Wakil Yadav vs State Of Bihar on 19 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
