Advocate\n\nHon'ble Vineet Saran,J.\n<\/pre>\n<p>Heard learned counsel for the applicant and learned A.G.A.\n<\/p>\n<p>The present 482 Cr.P.C. petition has been filed for quashing the charge sheet<br \/>\ndated 16.4.2009, proceedings of Case No. 2747 of 2009, under Sections 323,<br \/>\n325, 504, 506 IPC and 3 (1) X SC\/ST Act, pending in the Court of learned<br \/>\nChief Judicial Magistrate, Kanpur Dehat and summoning order dated<br \/>\n6.8.2209 passed in the aforesaid case.\n<\/p>\n<p>The contention of the counsel for the applicant is that no offence against the<br \/>\napplicant is disclosed and the present prosecution has been instituted with a<br \/>\nmalafide for the purposes of harassment. He pointed out certain documents<br \/>\nand statements in support of his contention.\n<\/p>\n<p>From the perusal of the material on record and looking into the facts of the<br \/>\ncase at this stage it cannot be said that no offence is made out against the<br \/>\napplicants. All the submission made at the bar relates to the disputed question<br \/>\nof fact, which cannot be adjudicated upon by this Court under Section 482<br \/>\nCr.P.C. At this stage only prima facie case is to be seen in the light of the law<br \/>\nlaid down by Supreme Court in cases of R.P. Kapur Vs. State of Punjab,<br \/>\nA.I.R. 1960 S.C. 866, State of Haryana Vs. Bhajan Lal, 1992 SCC (Cr.)<br \/>\n426, State of Bihar Vs. P.P.Sharma, 1992 SCC (Cr.) 192 and lastly Zandu<br \/>\nPharmaceutical Works Ltd. Vs. Mohd. Saraful Haq and another (Para-10)<br \/>\n2005 SCC (Cr.) 283. The disputed defence of the accused cannot be<br \/>\nconsidered at this stage. Moreover, the applicant has got a right of discharge<br \/>\nunder Section 239 or 227\/228, Cr.P.C. as the case may through a proper<br \/>\napplication for the said purpose and he is free to take all the submissions in<br \/>\nthe said discharge application before the Trial Court.\n<\/p>\n<p>The prayer for quashing the same is refused.\n<\/p>\n<p>However, in the recent decision of the Supreme Court dated 23.03.2009 in<br \/>\nCriminal Appeal No. 538 of 2009, <a href=\"\/doc\/1849898\/\">Lal Kamlendra Pratap Singh v. State of<br \/>\nU.P.,<\/a> which has been directed to be circulated in the High Court and in<br \/>\nsubordinate Courts in U.P., it has been observed that in appropriate cases the<br \/>\nCourt concerned may consider releasing an accused on interim bail, pending<br \/>\nconsideration of his regular bail, and that arrest was not a must in each case<br \/>\nwhen an First Information Report \/Complaint was lodged.\n<\/p>\n<p>The Full Bench of the Allahabad High Court in <a href=\"\/doc\/785145\/\">Amrawati v. State of U.P.,<\/a><br \/>\n2005 Cri. L.J. 755 has been specifically approved in this decision. In this<br \/>\nregard the Full Bench has held in Amarawati:\n<\/p>\n<blockquote><p>     1. Even if a cognizable offence is disclosed in the FIR or complaint the<br \/>\n       arrest of the accused is not a must, rather the police officer should be<br \/>\n       guided by the decision of the Supreme Court in <a href=\"\/doc\/601748\/\">Joginder Kumar v.<br \/>\n       State of U.P.,<\/a> 1994 Cr.L.J. 1981, before deciding whether to make an<br \/>\n       arrest or not.\n<\/p><\/blockquote>\n<blockquote><p>    2. The High Court should ordinarily not direct any Subordinate Court to<br \/>\n       decide the bail application the same day, as that would be interfering<br \/>\n       with the judicial discretion of the Court hearing the bail application.<br \/>\n       However, as stated above, when the bail application is under Section<br \/>\n       437, Cr.P.C. ordinarily the Magistrate should himself decide the bail<br \/>\n       application the same day, and if he decides in a rare and exceptional<br \/>\n       case not to decide it on the same day, he must record his reasons in<br \/>\n       writing. As regards the application under Section 439, Cr.P.C., it is in<br \/>\n       the discretion of the learned Sessions Judge considering the facts and<br \/>\n       circumstances whether to decide the bail application the same day or<br \/>\n       not, and it is also in his discretion to grant interim bail the same day<br \/>\n       subject to the final decision on the bail application later.\n<\/p><\/blockquote>\n<p>In the light of the aforesaid observations of the Apex Court in <a href=\"\/doc\/1849898\/\">Lal Kamlendra<br \/>\nPratap Singh v. State of U.P. and the<\/a> observations of the Full Bench of this<br \/>\nCourt in Amarawati, it is provided that if an application is moved before the<br \/>\ncompetent Magistrate within 3 weeks, a date may be fixed for appearance of<br \/>\nthe applicant in about a week thereafter. The applicant may not be arrested<br \/>\nwithout permission of the Magistrate between the date of moving of the<br \/>\napplication for surrender and the date fixed for his appearance in the Court. In<br \/>\nthe meantime the concerned Court may ask the prosecution to obtain<br \/>\ninstructions from the Investigating Officer and thereafter dispose of the bail<br \/>\napplication at the earliest in accordance with the decision in Amrawati&#8217;s case.<br \/>\nIt will also be open for the Court concerned to release the applicant on interim<br \/>\nbail in an appropriate case on such terms and conditions that the concerned<br \/>\nCourt deems fit and proper till the next date of hearing of the bail application,<br \/>\nif the hearing of the case is adjourned or the Court for any reason is not in a<br \/>\nposition to finally dispose of the bail application on that day, or some further<br \/>\ninstructions are needed.\n<\/p>\n<p>It is made clear that the order granting interim bail pending hearing of a<br \/>\nregular bail application may be passed in appropriate cases, but the powers<br \/>\nought not to be exercised where;\n<\/p>\n<p>(i) The case involves a grave offence like murder, dacoity, robbery, rape etc.<br \/>\nand it is necessary to arrest the accused and bring his movements under<br \/>\nrestraint to infuse confidence among the terror stricken victims and society at<br \/>\nlarge and for protecting witnesses.\n<\/p>\n<p>(ii) The case involves an offence under the U.P. Gangsters Act and in similar<br \/>\nstatutory provisions.\n<\/p>\n<p>(iii) The accused is likely to abscond and evade the processes of law.\n<\/p>\n<p>(iv) The accused is given to violent behaviour and is likely to commit further<br \/>\noffences unless his movements are brought under restraint.\n<\/p>\n<p> (v) The accused is a habitual offender and unless kept in custody he is likely<br \/>\nto commit similar offences again.\n<\/p>\n<p>(vi) The offence is in the nature of a scam, or there is an apprehension that<br \/>\nthere may be interference with the investigation or for any other reason the<br \/>\nMagistrate\/Competent Court feels that it is not a fit case for releasing the<br \/>\nappellant on interim bail pending the hearing of the regular bail.\n<\/p>\n<p>(vii) An order of interim bail can also not be passed by a Magistrate who is<br \/>\nnot empowered to grant regular bail in offences punishable with death or<br \/>\nimprisonment for life or under the other circumstances enumerated in Section<br \/>\n437 Cr.P.C.\n<\/p>\n<p>(viii) If the Public Prosecutor\/ Investigating Officer can satisfy the<br \/>\nMagistrate\/Court concerned that there is a bonafide need for custodial<br \/>\ninterrogation of the accused regarding various facets of motive, preparation,<br \/>\ncommission and aftermath of the crime and the connection of other persons, if<br \/>\nany, in the crime, or for obtaining information leading to discovery of<br \/>\nmaterial facts, it may constitute a valid ground for not granting interim bail,<br \/>\nand the Court in such circumstances may pass orders for custodial<br \/>\ninterrogation, or any other appropriate order.\n<\/p>\n<p>These directions are necessary as the need to grant plenary powers to the<br \/>\npolice to investigate and unravel the circumstances of a crime are as important<br \/>\nas the need to protect a respectable person from being unnecessarily sent to<br \/>\njail or for restraining the police from taking persons in custody for minor<br \/>\nisolated offences where it may strictly not be necessary for the police to arrest<br \/>\nan accused at the stage of investigation.\n<\/p>\n<p>With these observations the petition is disposed of.\n<\/p>\n<p>Order Date :- 7.1.2010<br \/>\nAbHishEK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Har Mohan Singh vs State Of U.P.And Another on 7 January, 2010 Court No. &#8211; 55 Case :- APPLICATION U\/S 482 No. &#8211; 158 of 2010 Petitioner :- Har Mohan Singh Respondent :- State Of U.P.And Another Petitioner Counsel :- Sanjay Srivastava Respondent Counsel :- Govt.
