A.L.DAVE)<\/p>\n<p>\tHeard<br \/>\nlearned advocate Mr.Sandeep Bhatt for the petitioner.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner has made the following prayers:-\n<\/p>\n<p>&#8220;(A)\tThe<br \/>\nHonourable Court may be pleased to admit \tthis Special Civil<br \/>\nApplication;\n<\/p>\n<p>(B)\tThe<br \/>\nHonourable Court may be pleased to issue \ta writ of mandamus or writ<br \/>\nin the nature of \tmandamus or writ of certiorari or a writ in \tthe<br \/>\nnature of certiorari or any other \tappropriate writ, order or<br \/>\ndirection by \tgranting fresh recognition or renew \trecognition to the<br \/>\npetitioner institute and \twith appropriate direction to respondents<\/p>\n<p>\t\tOr<br \/>\nin the alternatively<\/p>\n<p>\tBe<br \/>\npleased to direct the respondent-NCTE to \tdecide the appeal on merits<br \/>\nwithin time \tlimit;\n<\/p>\n<p>(C)\tPending<br \/>\nadmission, hearing and final \tdisposal of this petition, the<br \/>\nHonourable \tCourt may be pleased to grant interim relief \tby<br \/>\ndirecting respondent to consider and \tcommunicate fresh recognition<br \/>\nto the \tpetitioner by the respondent NCTE or may \tpass appropriate<br \/>\norder by directing the \trespondent in facts of the present case;\n<\/p>\n<p>\t(D)\tto<br \/>\ngrant such other and further relief as \t\tmay be deemed fit and proper<br \/>\nin facts and \t\tcircumstances of the case.&#8221;\n<\/p>\n<p>3.\tIt<br \/>\nis undisputed that an appeal is pending against NCTE and for the same<br \/>\nrelief this petition is filed. Under the circumstances, without<br \/>\nentering into  merits, we dispose of this petition with a direction<br \/>\nto respondent No.1 to decide the petitioner&#8217;s appeal expeditiously,<br \/>\npreferably before the end of December, 2011.
