APP (DB) No.1058 of 2010\n                                   JANESHWAR PANDEY\n                                             Versus\n                                      STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>04.   26.10.2010            Appellants in all these appeals have been<\/p>\n<p>                   convicted for the offence, punishable under section<\/p>\n<p>                   302\/148, 302\/149 of the Indian Penal Code and 27 of<\/p>\n<p>                   the Arms Act.\n<\/p>\n<p>                            Altogether 10 persons were killed in the<\/p>\n<p>                   occurrence.\n<\/p>\n<p>                            The case was instituted on the basis of<\/p>\n<p>                   Fardbeyan of P.W. 3, Uma Shankar Singh.<\/p>\n<p>                            The appellant, Dadan Pandey and Srikant<\/p>\n<p>                   Pandey in Criminal Appeal Nos. 1028 of 2010 and<\/p>\n<p>                   1120 of 2010, respectively, are said to have killed<\/p>\n<p>                   Ayodhya Chaurasia.\n<\/p>\n<p><span class=\"hidden_text\">                   2<\/span><\/p>\n<p>         The appellant, Janeshwar Pandey in Criminal<\/p>\n<p>Appeal No. 1058 of 2010 and Anil Kumar Singh in<\/p>\n<p>Criminal Appeal No. 1092 of 2010 are said to have<\/p>\n<p>killed Basisth Sah.\n<\/p>\n<p>         Arbind    Pandey   and   Birendra   Pandey   @<\/p>\n<p>Virendra Pandey are the appellants in Criminal Appeal<\/p>\n<p>No. 1068 of 2010. Arbind Pandey is said to have killed<\/p>\n<p>Sunil Kumar Singh and Birendra Pandey @ Virendra<\/p>\n<p>Pandey is said to have killed Ramashish Paswan.<\/p>\n<p>         All these appellants have been identified by<\/p>\n<p>P.W. 3, the informant. Besides that, they have been<\/p>\n<p>identified by some other witnesses also. Out of those<\/p>\n<p>witnesses, the evidence of P.W. 1, P.W. 6 and P.W. 12<\/p>\n<p>have not been relied upon by the Trial Court. So far<\/p>\n<p>P.W. 4 is concerned, since he did not turn up for<\/p>\n<p>cross-examination, his evidence has also not been<\/p>\n<p>considered by the Trial Court for conviction of the<\/p>\n<p>appellants. Then remains only one witness, i.e., P.W.<\/p>\n<p>13. P.W. 13 has also identified some of the appellants,<\/p>\n<p>such as Arbind Pandey and Birendra Pandey @<\/p>\n<p>Virendra Pandey.\n<\/p>\n<p>         Shri Kanhaiya Prasad Singh, Sr. Counsel<\/p>\n<p>appearing on behalf of the appellants, Arbind Pandey<\/p>\n<p>and Birendra Pandey @ Virendra Pandey, in Criminal<br \/>\n<span class=\"hidden_text\">                   3<\/span><\/p>\n<p>Appeal No. 1068 of 2010, submitted that the medical<\/p>\n<p>evidence do not corroborate the allegation against<\/p>\n<p>these appellants and so far P.W. 13 is concerned, his<\/p>\n<p>evidence would also not be considered for the reason<\/p>\n<p>that he was examined for the first time after 5-6 days<\/p>\n<p>of the occurrence and at the initial stage he has not<\/p>\n<p>disclosed the name of any of the accused.<\/p>\n<p>          In all these appeals, this is the submission of<\/p>\n<p>the counsel appearing for the appellants, who have<\/p>\n<p>been represented by Shri Rana Pratap Singh, Shri<\/p>\n<p>Yogesh Chandra Verma, Shri Rama Kant Sharma and<\/p>\n<p>Shri Ajay Kumar Thakur, Sr. Counsels, that this is a<\/p>\n<p>case in which conviction of the appellant is only on<\/p>\n<p>account of single identification. Other submissions<\/p>\n<p>have also been made in support of the appellants&#8217;<\/p>\n<p>claim for granting bail.\n<\/p>\n<p>          However,    considering   the   fact   that   the<\/p>\n<p>incident is not a case of normal occurrence of murder,<\/p>\n<p>rather it is a case of massacre. Several persons have<\/p>\n<p>been killed and so far the killing of 10 persons is<\/p>\n<p>concerned, that is not questionable and identification,<\/p>\n<p>as even by at least one witness, i.e., P.W. 3, Uma<\/p>\n<p>Shankar Singh, is consistent.\n<\/p>\n<p>          Considering this fact, we do not feel inclined<br \/>\n<span class=\"hidden_text\">                        4<\/span><\/p>\n<p>      to grant bail to any of the appellants for the present.<\/p>\n<p>      In case the appeal is not heard and decided within a<\/p>\n<p>      year, the appellant will have liberty to move and<\/p>\n<p>      renew their prayer for bail.\n<\/p>\n<\/p>\n<p>                           (Mridula Mishra, J.)<\/p>\n<p>                           (Dharnidhar Jha, J.)<br \/>\nSKM\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anil Kumar Singh vs State Of Bihar on 26 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
