Justice KURIAN JOSEPH\n\n Dated :30\/03\/2007\n\n O R D E R\n                              KURIAN JOSEPH, J.\n\n               - - - - - - - - -  - - - - - - - - - - - - - - - - - - - - - -\n\n                 W.P.(C)Nos.15522 &amp; 20111 OF 2005\n\n               - - - - - - - - -  - - - - - - - - - - - - - - - - - - - - - -\n\n                 Dated this the 30th day of March 2007\n\n\n                                    JUDGMENT\n<\/pre>\n<p>      The   issue   raised   in   this   writ     petition   pertains   to<\/p>\n<p>grievance   regarding   promotion   to   the   post   of   Agricultural<\/p>\n<p>Officers.  Petitioners are graduates.  85% of the vacancies are<\/p>\n<p>to   be   filled   up   by   direct   recruitment   and   the   qualification   is<\/p>\n<p>graduation.     However,   15%   vacancies   are   earmarked   to   be<\/p>\n<p>filled up by promotion.  As per the special rules for promotion<\/p>\n<p>as   Agricultural   Officer,   the   graduates   should   have   3   years<\/p>\n<p>service   whereas   non-graduates   had   to   pass   a   test   conducted<\/p>\n<p>by   Public   Service   Commission   and   also   they   had   to   be   in<\/p>\n<p>Agricultural   Assistant   Grade-I   for   a   period   of   three   years.<\/p>\n<p>Subsequently,   the   rules   are   amended   and  the   non  graduates<\/p>\n<p>need only have ten years service as Agricultural Assistant.  It<\/p>\n<p>is   not   necessary   that   they   should   be   in   grade-I.     Being<\/p>\n<p>graduates,   for   the   15%   quota   they   should   have   been<\/p>\n<p>separately   considered   at   least   for   a   limited   quota   since   non<\/p>\n<p>graduates   cannot   be   treated   at   par   with   graduates,   it   is<\/p>\n<p>W.P.(C)Nos.15522 &amp; 20111 OF 2005<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>submitted.     In   other   words,   it   is   a   situation   warranting   a<\/p>\n<p>classification lest it should violate the guarantee under Article<\/p>\n<p>14 of the Constitution of India.  It is seen that the Director of<\/p>\n<p>Agriculture   had   recommended   to   the   Government   the   need<\/p>\n<p>for such a classification of graduates and non-graduates in the<\/p>\n<p>matter   of   promotion   to   the   post  of   agricultural  officer   in   the<\/p>\n<p>15%   quota.     The   petitioners   would   further   contend   that   in<\/p>\n<p>various   other   services,   separate   treatment   is   given   to   the<\/p>\n<p>graduates.  It is also submitted that in the general rules when<\/p>\n<p>there   are   several   feeder   categories   for   promotion   to   a   post,<\/p>\n<p>the category with higher pay is to be preferred and the same<\/p>\n<p>principle should be applied in the case of feeder category for<\/p>\n<p>promotion   with   different   qualifications   and   hence  candidates<\/p>\n<p>with   higher   qualification   should   be   given   a   preferential<\/p>\n<p>treatment.     The   matter   was   considered   by   this   court   earlier<\/p>\n<p>leading   to   judgment   dated   5.10.2004   in   W.P.(C)No.29127\/04<\/p>\n<p>and   this   court   directed   the   Government   to   consider   the<\/p>\n<p>grievance   of   graduates   in   the   light   of   the   report   of   the<\/p>\n<p>W.P.(C)Nos.15522 &amp; 20111 OF 2005<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>Director   of   Agriculture.         The   Government   passed   the<\/p>\n<p>impugned order dated 23.2.2005  rejecting the request of the<\/p>\n<p>petitioners.  It is only stated that &#8220;the request for maintaining<\/p>\n<p>separate   seniority   list   for   graduates   and   for   giving   them   a<\/p>\n<p>separate   quota   for   promotion   are   devoid   of   merit   and<\/p>\n<p>therefore the request was rejected&#8221;.   The recommendation of<\/p>\n<p>the Director of Agriculture is not referred to in the impugned<\/p>\n<p>order.  There is no reference as to why the recommendation is<\/p>\n<p>not   considered,   despite   a   positive   direction   issued   by   this<\/p>\n<p>court in the judgment referred to above.\n<\/p>\n<\/p>\n<p>      2.     Having   regard   to   the   contentions   raised   by   the<\/p>\n<p>petitioners   and   having   regard   to   the   further   contention   that<\/p>\n<p>in various other services preferential treatment is given to the<\/p>\n<p>graduates   and   still   further   having   regard   to   the   direction<\/p>\n<p>already  issued  by this  court to consider  the  recommendation<\/p>\n<p>of the Director of Agriculture, I am of the view that the matter<\/p>\n<p>requires   reconsideration   by   the   Government.       I   quash   the<\/p>\n<p>impugned   Government   Order   with   a   direction   to   the<\/p>\n<p>W.P.(C)Nos.15522 &amp; 20111 OF 2005<\/p>\n<p><span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>Government to pass fresh orders adverting to the contentions<\/p>\n<p>taken by the petitioners some of which are referred to above.<\/p>\n<p>Orders as above shall be passed with notice to the petitioners<\/p>\n<p>and the affected  parties within a period of four  months  from<\/p>\n<p>the date of receipt of a copy of this judgment.
