Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.3246 OF 2009\n              ------------------------------------------\n\n               Dated      22nd     October 2009\n\n\n                           O R D E R\n<\/pre>\n<p>            Petitioner        was      the       first     accused  in<\/p>\n<p>C.P.178\/2005 on the file of Judicial First Class<\/p>\n<p>Magistrate, Kasaragod. Learned Magistrate committed<\/p>\n<p>the  case  to  the     Sessions         court       which   was  taken<\/p>\n<p>cognizance as S.C.322\/2006. As the                      petitioner was<\/p>\n<p>absconding, only accused 3 and 4 were tried. Second<\/p>\n<p>accused being a juvenile, the case was not committed<\/p>\n<p>to the Sessions court and instead charge was laid<\/p>\n<p>before  Chief Judicial Magistrate, Kasaragod. When co-<\/p>\n<p>accused were tried,       second respondent, the de facto<\/p>\n<p>complainant turned hostile           to the prosecution and by<\/p>\n<p>Annexure-III  judgment those accused were acquitted.<\/p>\n<p>Prosecution case is that second respondent is a member<\/p>\n<p>of Scheduled caste and on 24\/4\/2005 at 2 p.m accused 1<\/p>\n<p>to 3 who do not belong to Scheduled caste                          and<\/p>\n<p>Scheduled Tribe,     forcibly          took       her     in   an auto<\/p>\n<p>rickshaw     KL-14\/D-3472          and      brought       her   to  an<\/p>\n<p>unnumbered newly built house with an intention to<\/p>\n<p>Crmc 3246\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>outrage her modesty and commit rape, caught her<\/p>\n<p>breast    and attempted  to undress    her  and  also<\/p>\n<p>attempted to commit rape and thereby   committed the<\/p>\n<p>offences under Sections 511 of 376, 366, 354, 536(1)<\/p>\n<p>read with Section 34 of Indian Penal Code. This<\/p>\n<p>petition is filed under Section 482 of Code of<\/p>\n<p>Criminal Procedure to quash the case as against the<\/p>\n<p>petitioner,   which  is  now pending  as  L.P.12\/2008<\/p>\n<p>before the Sessions court, Kasaragod contending that<\/p>\n<p>in view of the order of acquittal as against the  co-<\/p>\n<p>accused and settlement of the dispute with the second<\/p>\n<p>respondent, it is not in the interest of justice to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>            3.  Second respondent appeared through a<\/p>\n<p>counsel and also filed an affidavit  stating that the<\/p>\n<p>matter has been      settled due to intervention of<\/p>\n<p>mediators and consequent to the settlement, she has<\/p>\n<p>no intention to proceed with the case further and she<\/p>\n<p>has no objection for quashing the proceedings. Second<\/p>\n<p>respondent    along  with  petitioner jointly   filed<\/p>\n<p>Crl.M.A.5571\/2009 for compounding the offence, by<\/p>\n<p>quashing the proceedings. As the offences are not<\/p>\n<p>compoundable as provided under Section 320 of Code of<\/p>\n<p>Crmc 3246\/09<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>Criminal    Procedure,  permission   to  compound   the<\/p>\n<p>offence cannot be granted.\n<\/p>\n<p>            4.  Learned   counsel  appearing  for   the<\/p>\n<p>petitioner,    second  respondent  and  learned  Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>            5.  Though  ordinarily  an  offence   under<\/p>\n<p>Section 376 or 511     of Section 376 of Indian Penal<\/p>\n<p>Code   is   not  to  be  quashed,  invoking the  extra<\/p>\n<p>ordinary powers of this court    under Section 482   of<\/p>\n<p>Code of Criminal Procedure, based on the settlement<\/p>\n<p>arrived at later, facts of the case    reveal that even<\/p>\n<p>when    the remaining two accused were tried by the<\/p>\n<p>learned Sessions Judge,      second respondent turned<\/p>\n<p>hostile to the prosecution and deposed that she could<\/p>\n<p>not identify the person who committed the alleged<\/p>\n<p>acts against her.     It is for   want of evidence, as<\/p>\n<p>against them the said accused were acquitted under<\/p>\n<p>Annexure-III judgment. In the light of the said<\/p>\n<p>judgment, even if second respondent is to examine the<\/p>\n<p>chances of a successful prosecution is very bleak.<\/p>\n<p>Added   to   this,  affidavit    filed  by  the  second<\/p>\n<p>respondent     establish   that   consequent   to   the<\/p>\n<p>settlement     she is not intending to give evidence<\/p>\n<p>Crmc 3246\/09<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>against the petitioner. In such circumstances, even<\/p>\n<p>if petitioner is to be directed to undergo the ordeal<\/p>\n<p>of a trial, it would only result in unnecessary waste<\/p>\n<p>of valuable time of the court. In such circumstances,<\/p>\n<p>it is not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>            Petition is allowed.
