State.  Though<br \/>\nserved, nobody has remained present before this Court.  The complaint<br \/>\nwas lodged on 1.4.1987. Mr.Desai has submitted that, in such kind of<br \/>\ncases, the sentence awarded is quite inadequate.\n<\/p>\n<p>3.\tSection<br \/>\n28 of the Payment of Wages Act, 1965 is reproduced below:\n<\/p>\n<p>\t?S28.\n<\/p>\n<p>Penalty.&#8211;If any person&#8211;\n<\/p>\n<p>\t(a)\tcontravenes<br \/>\nany of the provisions of this ?\t\tAct or any \t\trule made thereunder;\n<\/p>\n<p>\t\tor<\/p>\n<p>(b)\tto<br \/>\nwhom a direction   is   given  or  a \trequisition is made under this<br \/>\nAct fails to comply with the direction or requisition,<\/p>\n<p>he<br \/>\nshall be punishable with imprisonment for a term which may extend to<br \/>\nsix months, or with fine which may extend to one thousand rupees, or<br \/>\nwith both.??\n<\/p>\n<p>As<br \/>\nper the above Section, if any person contravenes the provisions of<br \/>\nthe Act shall be punishable with imprisonment for a term which may<br \/>\nextend to six months, or with fine which may extend to one thousand<br \/>\nrupees, or with both.\n<\/p>\n<p>4.\tIn<br \/>\nthe present case, the learned Magistrate has imposed a fine of<br \/>\nRs.20\/- only on each of the respondent accused and sentenced them to<br \/>\nundergo simple imprisonment of two months, in default of payment of<br \/>\nthe same.  Taking this fact into consideration  as a technical aspect<br \/>\n and that the appeal is of the year 1989, in the opinion of this<br \/>\nCourt, the appeal deserves to be dismissed and it is accordingly<br \/>\ndismissed.
