accused was performed about two years prior to the dajte.of<\/p>\n
incident at Sogalamma temple in Sogaili <\/p>\n

started suspecting the fidelity of his i;\u00abiife:-‘an7d\u00ab’th.’e.re’- <\/p>\n

her. That on 4.12.2003 at  took
\nhis wife to land beari”ng’_.*i  belonging to
\nChowdabaik. There.–t;he_   by means of
\na chopper on  <\/p>\n
(3) The Shetty. He has
\nstated in 34.12.2003 at about 7 p.m.
\nwhen h6,\u00a7’nd..hi’sV  the house, his son Krishna<\/p>\n
caine panic situation and he totd that at about 3<\/p>\n
 p.m.:”on….that7″‘_d0ay~;”he assaulted his wife by means of a<\/p>\n
Vl\ufb01chopper  her. He also showed his clothes which<\/p>\n
\u00ab:.*iwe.?:ei.biood stained. Thereafter compiainant informed the<\/p>\n

villagers. ~l”hen Sreenivasshetty, Venkataramana Shetty,<\/p>\n
Jayaram, K. Srinivas and Shivappa came to the houserand<\/p>\n
enquired his son Krishna Shetty and in their pre_s’encei__:’t~lie’<\/p>\n
accused stated that he killed his wife  <\/p>\n
assaulting her by means of chopper=\u00bb.:’oni:-A-herunec.l-rtjday  was no

\nhim on the7next- On the complaint
\nlodged on  the Police registered<\/p>\n

under;Sectioyn’~3’O:2″vof IPC and accused was remanded to<\/p>\n

   Police investigated the case and laid the<\/p>\n
‘ ‘V:i”ch.l;ji?gelt%sheet against the accused for the offence punishable<\/p>\n

under section-3G2 of IPC. The iearned Sessions Judge has<\/p>\n
framed the charge for the offence punishable under section-<\/p>\n
302 of IPC. Charge was read over and plea <\/p>\n

therefore it is aileged that accused committed the murder<\/p>\n
of his wife. The learned counsei for the appeiiant <\/p>\n
that the offence may not fall under section–302  <\/p>\n
he suspected the fidelity of his wife””an.d_ <\/p>\n

(10) In order to test the soundness of the decision<\/p>\n
recorded by the Court below, we have carefully exam-i..ned<\/p>\n
the evidence of the prosecution witnesses. V.<\/p>\n

has turnedT__   prosecution relies on his
\nevidence in re\u00abs'pect_of' e.\u00a7<it'ra::j'udiciaI confession. PW–13 is
\nthe_Junio.r\u00a71:Engineer"i\u00ab.n:_;i_lla Panchayath who has prepared<\/p>\n
the'_sketchV o.Vfu'th'eA:"svcene of offence. PW-14 is the panch.<\/p>\n
 speak'si'aboc"t*;_t'i*ie seizure of blood stained mud, grass,<\/p>\n
_ip_i'_e'ce$ of PW–15 is the panch witness. PW~16 is<\/p>\n
  of Mahiia Samaj and she speaks about motive.<\/p>\n
it  17, 18 and 19 are the police officials.<\/p>\n

(11) The material witnesses in this case are PWs.4..__6,9<\/p>\n
and 10. Now we shall examine their evidence.<\/p>\n
(12) PW-4 is the mother of the deceasedy. <\/p>\n
that deceased Mangalamma was, given\u00bb.gin-._margriagAe’ to ‘–the V’<\/p>\n
accused. For about two months’l\u00bb.:afte_r the the
\naccused looked after the;::y_’dece’e.s’\u00a7\u00a7jt*:’:.yye’l’l~.andvxthvereafter
\nsuspecting her fidelity, he used_ \ufb01e was also
\nassaulting her  of their family.\n<\/p>\n
 take the deceased also for
\ncoolie work.   he was not going out.\n<\/p>\n
Decegasedelone was coolie work.\n<\/p>\n
  states one day about a year and five<\/p>\n
i.’v\u00bb._rrionths–:”t\u00a7a’cl\u00a7V,’AR.l:’heg’i:=.accused took the deceased from his<\/p>\n
\ufb01hgo\u00e9use saying\u00b0’VA.Vthat they would bring \ufb01re wood. He also<\/p>\n
 him machhu. Both of them did not return to<\/p>\n

the house on that day. She searched for them. Then___ she<\/p>\n
thought that they might have gone to Kalastir, the <\/p>\n
the accused. On the next day morning, she <\/p>\n
moving about saying that the hust\ufb01arid-.\u00e9of~’_4’Ma’n’ig.a_ia’ <\/p>\n

\ntheir house   She further states
\nthat the accused  where he had thrown

 ‘{ifa(i_4)”~..:PW-6 is the brother of PW~–~4. Accused is the<\/p>\n
l’ V–‘sio..;*iV’4″in-li:aw of PW~4. He states in his evidence that about a<\/p>\n
if<\/p>\n
year and five months back, PW-4’5 daughter died, On the<\/p>\n
day of the incident, the accused and the deceased<\/p>\n
towards a street. The accused carried with<\/p>\n
Kadukatti. They did not return that night. T~i*:*ev-yi:~searChVed:it  <\/p>\n
for them and thought that they mightthaxgea..go4\u00e9’ae1to”‘K’a’ias_u’iri::sva_it<\/p>\n
Next clay morning peopie were teiitgzg thatithe ia:c’cvu’3.eq had <\/p>\n

(15) During his;’cvrossfVeV$\u00a7’a_njin:at’i’o.n,”h’aVv’Vstates that no<\/p>\n
panchayath wascfispute between the<\/p>\n
accused and the  is true that a week or a
\nmonth earlier t’o__the \u00e9n’cider1-tifnoiquarrei took piace between
\nthe accusegdiv and thatadeceiiased. When the people were<\/p>\n
tai’Ki_ng:Va.bVQu.tA_ ‘t.he,A:V”m_urder of the deceased by the accused,<\/p>\n

He further states in his evidence that one day about a year<\/p>\n
back, when he was in front of his house, the accusvedjand<\/p>\n
the deceased were coming and when he asked <\/p>\n

going for bringing fire wood. He had w’,i’th:’him_.’ a <\/p>\n

his testi <\/p>\n
(i7)'*riPW%iV–Vi3;_ isthe sister of the deceased. She states<\/p>\n
_kji..n_,"rie_r evide=2nc\u00a7_evthat her sister died about a year and five<\/p>\n
'back. On 4.12.2003, she prepared the breakfast<\/p>\n
V'  the same to PW–4, the accused and the deceased.<\/p>\n
examined by the defence counsel, nothing worthwh_i__l_e is<\/p>\n
elicited to discredit her testimony.\n<\/p>\n

submits that in this case, the doctor has no\u00abtg_i:i.ee.n <\/p>\n
