KODEKAR APP for\nApplicant \nRULE SERVED for Respondent  Nos. 1 - 2, 4, 6 \nMR\nHARNISH V DARJI for Respondent Nos. 3 &amp; 5 \nMR UTPAL M PANCHAL\nfor Respondent No. 7 \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.C.UPADHYAYA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/08\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1\tBy<br \/>\n filing instant Application under Section-5 of the  Limitation<br \/>\nAct,1963, the applicant   State of Gujarat, has prayed to condone<br \/>\ndelay of  62 days caused in filing the  above numbered criminal<br \/>\nappeal, which is directed  against the judgment and order dated<br \/>\n31.8.2009,  rendered in  Sessions Case No. 4 of 2008,  by  the<br \/>\nlearned Additional Sessions Judge, Surat, by which the respondents<br \/>\naccused persons  came to be acquitted  for the offences punishable<br \/>\nunder Sections  395, 354 and  328  of the I.P.C.\n<\/p>\n<p>2\t\tThe<br \/>\nreasons  as to why the Appeal   could not be  filed in time  are<br \/>\ndetailed in paragraphs 3 and 4 of the application. The averments made<br \/>\nin the application  are supported by an affidavit sworn by G.P.<br \/>\nRathod, Under Secretary, Legal Department, Sachivalaya, Gandhinagar.<br \/>\nIt is  inter alia stated that  because of  intra-department  and<br \/>\ninter-department procedure for obtaining sanction to file appeal,<br \/>\nconsiderable time is consumed and thereafter the matter was sent to<br \/>\nthe Office of the learned Public Prosecutor,  High Court of Gujarat.<br \/>\nThere also, considerable time  has been consumed for preparing  draft<br \/>\nand, therefore, the delay has been occurred.  It is, therefore,<br \/>\nprayed to condone the delay.\n<\/p>\n<p>3\t\tThough<br \/>\nthe  Rule issued to Respondent Nos. 1, 2, 4 and 7 has been served,<br \/>\nthey have elected not to remain present.\n<\/p>\n<p>4\t\tHaving<br \/>\nconsidered the submission advanced by  Mr. R.C. Kodekar, learned APP<br \/>\nfor the applicant   <a href=\"\/doc\/433430\/\">State of Gujarat, Mr. Harnish V. Darji,<\/a> learned<br \/>\nAdvocate  for   respondent Nos. 3 and 5 and Mr. Utpal M. Panchal,<br \/>\nlearned Advocate for  respondent No.7 and a perusal of the averments<br \/>\nmade in the application which have remained uncontroverted, and also<br \/>\nconsidering  the celebrated principles governing the discretionary<br \/>\nexercise of power conferred under  Section-5 of the Act  so also  the<br \/>\nreported decisions of the Hon&#8217;ble Supreme Court construing Section 5<br \/>\nof the Act liberally,  we are of the considered opinion that delay<br \/>\ncaused in filing the appeal has been  aptly, elaborately and<br \/>\nsufficiently explained. The record does not  indicate there was<br \/>\ninaction or negligence  on the part of the applicant in prosecuting<br \/>\nthe Appeal.  The applicant has  never abandoned   the lis.   The<br \/>\nexplanation for condonation of  delay offered by the applicant  is<br \/>\nnot only plausible but  acceptable.\n<\/p>\n<p>5\t\tIn<br \/>\nthe aforesaid view of the matter, since there was sufficient  cause<br \/>\nwhich prevented  the applicant in filing the Appeal in time,<br \/>\napplication deserves to be allowed by condoning the delay as prayed<br \/>\nfor.\n<\/p>\n<p>6\t\tFor<br \/>\nthe foregoing reasons,  the application succeeds and    accordingly<br \/>\nit is allowed.
