Justice R.BASANT\n\n Dated :16\/10\/2007\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                       B.A.No.6152 of 2007\n                   ----------------------------------------\n             Dated this the 16th day of October 2007\n\n                              O R D E R\n<\/pre>\n<p>      Application for anticipatory bail.              The petitioner is the<\/p>\n<p>seventh accused in a crime registered for offences punishable<\/p>\n<p>inter alia under Sections 120B and 364 I.P.C. The first accused<\/p>\n<p>allegedly had disputes with the de facto complainant. He had<\/p>\n<p>entered into a conspiracy along with others including the<\/p>\n<p>petitioner herein. The de facto complainant was allegedly taken<\/p>\n<p>away in an attempt to coerce him to part with money. I have<\/p>\n<p>considered facts in detail in the application for regular bail filed<\/p>\n<p>by some of the co-accused. The petitioner is alleged to be one of<\/p>\n<p>the conspirators and he allegedly had played an active role in the<\/p>\n<p>abduction and illegal detention of the de facto complainant.<\/p>\n<p>Investigation is in progress.               The petitioner apprehends<\/p>\n<p>imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is not the real accused arrayed as the seventh<\/p>\n<p>accused.   Another Dilshad is really made an accused.                  That<\/p>\n<p>Dilshad happens to be a very influential person belonging to the<\/p>\n<p><span class=\"hidden_text\">B.A.No.6152\/07                   2<\/span><\/p>\n<p>ruling party and therefore the petitioner, who bears the same<\/p>\n<p>name is unnecessarily and unfortunately dragged into the<\/p>\n<p>controversy.   The petitioner does not deserve to endure the<\/p>\n<p>trauma of arrest and detention. He shall co-operate with the<\/p>\n<p>investigating officers. Appropriate conditions may be imposed.<\/p>\n<p>The petitioner may be saved of the undeserved trauma of arrest<\/p>\n<p>and detention, submits the learned counsel for the petitioner.<\/p>\n<p>      3.    The   learned   Public     Prosecutor    opposes   the<\/p>\n<p>application.   The learned Public Prosecutor submits that the<\/p>\n<p>allegations are serious. There is absolutely no reason to assume<\/p>\n<p>that the petitioner has been substituted for a real accused in the<\/p>\n<p>anxiety to save the real accused from this prosecution.       The<\/p>\n<p>confession of the arrested accused as well as other materials<\/p>\n<p>collected clearly point to the complicity of the petitioner. The<\/p>\n<p>petitioner is the one who is arrayed as the seventh accused.<\/p>\n<p>Satisfactory inputs are available to array the seventh accused.<\/p>\n<p>The contention of the petitioner that he is not the seventh<\/p>\n<p>accused and that no materials have been collected against the<\/p>\n<p>seventh accused is not justified at all, submits the learned Public<\/p>\n<p>Prosecutor.     The case diary has already been perused by me.<\/p>\n<p>The same has been perused by me today also.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.6152\/07                   3<\/span><\/p>\n<p>     4.     Having considered all the relevant circumstances, I<\/p>\n<p>am not persuaded to agree that this is a fit case where the<\/p>\n<p>discretion under Section 438 Cr.P.C can or ought to be invoked.<\/p>\n<p>This, I am satisfied, is a fit case where the petitioner must<\/p>\n<p>appear before the investigating officer or the learned Magistrate<\/p>\n<p>having jurisdiction and then seek regular bail in the normal and<\/p>\n<p>ordinary course.\n<\/p>\n<p>     5.     In the result, this petition is dismissed.
