However, since the company is in<br \/>\nliquidation, workman would be entitled to wages from 1.1.1987 to the<br \/>\ndate of subsequent termination or the date of winding up order, which<br \/>\never is earlier.\n<\/p>\n<p>4.0\tIt<br \/>\nappears that the applicant had preferred an application being Company<br \/>\nApplication No.5 of 2005 claiming sum of Rs.2,88,044\/- in pursuance<br \/>\nof the above said award dated 29.01.1998 passed by the Industrial<br \/>\nCourt. The learned company judge passed an order dated 14.10.2005<br \/>\npartly allowing the application and directing the Official Liquidator<br \/>\nto pay, on ad hoc basis, sum<br \/>\nof Rs.10,000\/- to get the claim of the applicant duly verified, if<br \/>\nrequired by the Chartered Accountant and then to make payment at par<br \/>\nwith other similarly situated workers whenever the payment to the<br \/>\nother workers is made under Section 529(A) of the Companies Act. The<br \/>\nCourt also directed the Official Liquidator to include the<br \/>\napplicant&#8217;s name in the list of eligible claimants so that the<br \/>\napplicant workman could be paid at par with other similarly situated<br \/>\nworkers whenever the disbursement under Section 529(A) of the Act is<br \/>\nmade by Official Liquidator.\n<\/p>\n<p>5.0<br \/>\nNow the applicant has come forward with a grievance that though six<br \/>\nyears have passed after the said order dated 14.10.2005 and all the<br \/>\nworkers have already been paid their full dues under Section 529(A)<br \/>\nof the Act, somehow the Official Liquidator has not made any payment<br \/>\nto the applicant workman (except aforesaid amount of Rs.10,000\/) that<br \/>\ntoo despite the direction vide order dated 14.10.2005. It is not in<br \/>\ndispute that the amount payable towards wages and other benefits<br \/>\nunder Section 529(A) have been disbursed in favour of other workers<br \/>\nof the company.\n<\/p>\n<p>6.0<br \/>\nHaving regard to the direction given by the Court vide order dated<br \/>\n14.10.2005 and having regard to the fact that despite the said order<br \/>\nthe payments have not been made to the applicant workman and the fact<br \/>\nregarding the delay of six years which is caused since the order<br \/>\npassed in Company Application No.5 of 2005, below mentioned<br \/>\ndirections are passed.\n<\/p>\n<p> a)<br \/>\nIf the Official Liquidator has not got the claim of the workman<br \/>\nverified by the Chartered Accountant in light of and despite the<br \/>\nearlier order dated 14.10.2005 in Company Application No.5 of 2005,<br \/>\nthe Official Liquidator shall immediately get the said work completed<br \/>\nforthwith and without any delay and not later than two weeks;\n<\/p>\n<p>b)\tIf<br \/>\nthe claim of the workman\/applicant-worker is not got duly verified by<br \/>\nthe Official Liquidator until now despite the said order dated<br \/>\n14.10.2005 then in that event the Official Liquidator shall also pay<br \/>\nadditional sum of Rs.1,000\/- to the workers towards cost. The said<br \/>\namount will not be paid from the amount realized from the sale of<br \/>\nproperty of the company but from the account of his administrative<br \/>\nexpenditure;\n<\/p>\n<p>c)\tIf<br \/>\nthe Official Liquidator has already got the claim verified but has<br \/>\nnot made the payment until now in accordance with earlier order dated<br \/>\n14.10.2005 along with other workers then in that event the Official<br \/>\nLiquidator shall take necessary steps to make payment to the<br \/>\napplicant workers, after verifying the proof of identity (to be<br \/>\nsubmitted by the applicant workman) within two weeks from the receipt<br \/>\nof this order. The payment to be made only by E-transfer \/ Account<br \/>\nPayee cheque directly in the account of the applicant workman;\n<\/p>\n<p>d)\tThe<br \/>\npayment shall be made having regard to the total payment made to<br \/>\nother similarly situated workers of the company in liquidation until<br \/>\nnow;\n<\/p>\n<p>e)\tIf<br \/>\ndespite the completion of job of verification of the applicant&#8217;s<br \/>\nclaim and the Official Liquidator has failed to make payment then<br \/>\nabove referred condition (in clause (b)) regarding payment of cost<br \/>\nwill be applicable and shall be paid by the Official Liquidator in<br \/>\nsame manner;\n<\/p>\n<p>f)\tIf<br \/>\nthe Official Liquidator has not got the verification of the<br \/>\napplicant&#8217;s claim carried out then, as aforesaid the said part of the<br \/>\nrequirement will be completed, within two weeks as mentioned above<br \/>\nand payment shall be made within one week after the receipt of the<br \/>\nreport of the Chartered Accountant;\n<\/p>\n<p>g)\tIn<br \/>\nthe event the Official Liquidator fails to comply with the<br \/>\ndirections, it will be open to the applicant workman to revive<br \/>\npresent application by filing appropriate note. In that event the<br \/>\nOfficers responsible for delay in complying the order shall be held<br \/>\npersonally liable for causing delay and appropriate orders including<br \/>\nthe payment of cost from his own fund will be passed by the Court.\n<\/p>\n<p>7.0<br \/>\nThis order is passed because this Court has, in may cases, come<br \/>\nacross instances wherein despite the directions by the Court, and<br \/>\nthat too repeated directions, the office of the Official Liquidator<br \/>\ndoes not take steps to comply the directions including the directions<br \/>\nwhich requires payment to the workers of the company in liquidation<br \/>\nor to complete the preliminary stages\/steps which lead to the payment<br \/>\nto the workers. Having regard to the requests made by Official<br \/>\nLiquidator every time such defaults on the part of the Official<br \/>\nLiquidator are condoned after making appropriate observations and<br \/>\nputting award of caution, however, no improvement in the conduct or<br \/>\nthe affairs of the office of the Official Liquidator is noticed.\n<\/p>\n<p>8.0\tAs<br \/>\nmentioned above, in the present case, even after the delay of six<br \/>\nyears since the order was passed by the Learned Company Judge,<br \/>\nOfficial Liquidator has failed to take any action, and, therefore,<br \/>\nthe Court has been compelled to pass order requiring payment of cost<br \/>\nfrom the funds of the Office of the Official Liquidator;\n<\/p>\n<p>9.0\tWith<br \/>\nthe aforesaid directions and clarification present application is<br \/>\ndisposed of.\n<\/p>\n<p>[K.\n<\/p>\n<p>M.
