JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/06\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Articles 226 and 227 of the Constitution of India has<br \/>\nbeen filed, with the following prayers :\n<\/p>\n<p>&#8220;A)\tThat<br \/>\nthis Hon&#8217;ble Court may be pleased to admit this Special Civil<br \/>\nApplication.\n<\/p>\n<p>B)\tThis<br \/>\nHon&#8217;ble Court may be pleased to allow this Special Civil Application<br \/>\nby issuing a fresh passport to the petitioner and correcting the name<br \/>\nof the mother of the present petitioner in the passport No.G-1207885<br \/>\nissued to the petitioner as &#8220;Rai Gangaben Narottambhai&#8221;<br \/>\ninstead of Rai Chanchalben Narottambhai in the interest of justice.\n<\/p>\n<p>C)\tGrant<br \/>\nsuch other and further relief(s) as deemed just and proper by this<br \/>\nHon&#8217;ble Court in the interest of justice.&#8221;\n<\/p>\n<p>2.\tThe<br \/>\ngrievance of the petitioner is that the name of his mother in the<br \/>\npassport issued to him on 11.01.2007, is not correctly recorded,<br \/>\nbeing mentioned as Rai Chanchalben Narottambhai, whereas the correct<br \/>\nname is Rai Gangaben Narottambhai. The petitioner has made a detailed<br \/>\nrepresentation to the respondent (Regional Passport Officer) on<br \/>\n01.03.2011 for correction of the name of his mother in the said<br \/>\npassport, but neither has any reply been received from the<br \/>\nrespondent, and nor has any process been initiated for correction of<br \/>\nthe name of the petitioner&#8217;s mother. Hence, the present petition.\n<\/p>\n<p>3.\tAt<br \/>\nthe outset, Mr.Nirav Sanghvi, learned advocate for Mr.Ashish M.<br \/>\nDagli, learned counsel for the petitioner submits that the interest<br \/>\nof justice would be met, if the respondent is directed to consider<br \/>\nand decide the representation made by the petitioner within a<br \/>\nstipulated period of time.\n<\/p>\n<p>4.\tHeard<br \/>\nMr.Nirav Sanghvi, learned advocate for Mr.Ashish M. Dagli, learned<br \/>\ncounsel for the petitioner and Mr.Y.V.Vaghela, learned Central<br \/>\nGovernment Standing Counsel for the respondent, who has appeared on<br \/>\nsupply of an advance copy of the petition, as directed by the Court.\n<\/p>\n<p>5.\tIn<br \/>\nview of the statement made by the learned counsel for the petitioner,<br \/>\nthe following order is passed :\n<\/p>\n<p>\tThe<br \/>\nrespondent (Regional Passport Officer) shall consider and decide the<br \/>\nrepresentation dated 01.03.2011 made by the petitioner regarding the<br \/>\ncorrection of the name of his mother in passport No.G1207885, which<br \/>\nhas been issued to him on 11.01.2007.\n<\/p>\n<p>\tWhile<br \/>\ndoing so, the respondent shall afford the petitioner an opportunity<br \/>\nof being heard.\n<\/p>\n<p>\tIt<br \/>\nis open to the respondent to call upon the petitioner to produce any<br \/>\ndocuments that may be necessary in order to decide the matter.
