No.35371\/2008-J\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n          Dated this the 11th day of February, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    Aggrieved   by  the   inaction  on  the  part  of   the<\/p>\n<p>respondents  in  assigning  the   land  in favour  of   the<\/p>\n<p>petitioner as ordered in Ext.P1, this writ petition has<\/p>\n<p>been filed.\n<\/p>\n<p>    2.   The  petitioner  applied  for  assigning  a  total<\/p>\n<p>extent of 25 cents of land in Re-survey Nos.58, 60 and<\/p>\n<p>215\/3 of Bare Village which according to him is in his<\/p>\n<p>possession  for  the  last  fifty  years.   His  claim  was<\/p>\n<p>originally rejected by the Assigning Authority as per order<\/p>\n<p>dated 06\/02\/1989 and the appeal filed was confirmed by the<\/p>\n<p>Appellate Authority, namely, the second respondent as per<\/p>\n<p>order dated 07\/09\/1989.   Finally, a revision petition was<\/p>\n<p>filed before the first respondent-District Collector which<\/p>\n<p>was allowed as per Ext.P1 order.\n<\/p>\n<p>    3.   According to the petitioner, he has effected vast<\/p>\n<p>and valuable improvements in the property also and seeking<\/p>\n<p>for issuance of patta he has filed Ext.P2 application<\/p>\n<p>before the first respondent.\n<\/p>\n<p>    4.   The   third   respondent  has   filed  a   counter<\/p>\n<p>affidavit. Circumstances leading to the non compliance of<\/p>\n<p>Ext.P1 order passed by the District Collector have been<\/p>\n<p>W.P.(C). No.35371\/2008<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>detailed in the counter affidavit.           It is averred in<\/p>\n<p>paragraph (5) that the land in Re-survey Nos.215\/3B is AW<\/p>\n<p>which lies adjoining to PWD road.         Hence, consent of the<\/p>\n<p>PWD authorities is required.       Besides, a mass petition from<\/p>\n<p>the people of the locality objecting assignment of the land<\/p>\n<p>is pending also.       It is assured that action will be taken<\/p>\n<p>in accordance with the prevailing KLA Act and Rules.          A<\/p>\n<p>small portion of AW is set apart for military persons.<\/p>\n<p>     5.      In   the  light  of  Ext.P1  order  passed  by the<\/p>\n<p>District Collector, there cannot be any dispute that the<\/p>\n<p>revision has been allowed in favour of the petitioner.       In<\/p>\n<p>Ext.P1, the District Collector has ordered that the land<\/p>\n<p>may be assigned to the encroacher after leaving sufficient<\/p>\n<p>space to the road margin.      Therefore, what is the extent of<\/p>\n<p>land available for assigning to the petitioner is the<\/p>\n<p>matter to be considered by the third respondent.      As Ext.P1<\/p>\n<p>has become final, the objection that a portion of the land<\/p>\n<p>cannot    be    assigned   at  all,  cannot  be  taken  by   the<\/p>\n<p>respondents, as a ground to deny the assignment of the<\/p>\n<p>available land.\n<\/p>\n<p>     6.        Therefore, there will be a direction to the<\/p>\n<p>respondents      to   complete the   process and  finalise  the<\/p>\n<p>W.P.(C). No.35371\/2008<br \/>\n<span class=\"hidden_text\">                            -:3:-<\/span><\/p>\n<p>procedure for assignment as ordered in Ext.P1 within a<\/p>\n<p>period of four months from the date of receipt of a copy of<\/p>\n<p>this Judgment, after hearing the petitioner.<\/p>\n<p>     The writ petition is disposed of as above.
