Respondent, Assistant Supdt., Stores, in<br \/>\nSafdarjung Hospital, was appointed Assistant Administrative<br \/>\nOfficer (AAO) (Group D) on ad hoc basis for three months or<br \/>\ntill regular appointment was made to the post whichever was<br \/>\nearlier by order dated 31.1.1997 passed by petitioner No. 2.<br \/>\nHis term was not extended thereafter. However, in response<br \/>\nto his correspondence, it was recorded in an officer note<br \/>\ndated 22.7.1999 that since no extension was granted in his<br \/>\nterm, he would stand reverted to his post of Assistant<br \/>\nSupdt. (Stores). He challenged this in OA No. 1654\/99 and<br \/>\npetitioners contested this on the plea that once his term<br \/>\nwas not extended he stood reverted automatically to his<br \/>\nsubstantive post of ASS. Moreover, post of AAO was to be<br \/>\nfilled up on regular basis by selection from amongst the<br \/>\nfeeding cadres having five years experience in that cadre.<br \/>\nIt was also claimed that respondent was also considered by<br \/>\nthe DPC for regular appointment at one stage but was not<br \/>\nfound eligible as he felt short of requisite five years<br \/>\nservice as ASS.\n<\/p>\n<p> 2. Tribunal, however, on tracing respondent&#8217;s service<br \/>\ngraph qua his other two colleagues, M\/s. Gupta &amp; Majhi took<br \/>\nthe view that he was unjustly dealt with and quashed office<br \/>\nnote dated 22.7.1999 reverting him to post of ASS. It<br \/>\nfurther directed that he shall be deemed to have continued<br \/>\nas AAO from February 1997 and considered for regularisation<br \/>\nof his services on the post.\n<\/p>\n<p> 3. Petitioners feel aggrieved of this. Their case is<br \/>\nthat respondent&#8217;s appointment as AAO was ad hoc for three<br \/>\nmonths and his appointment order dated 31.1.1997 made it<br \/>\nclear that it would not confer any right for regularisation<br \/>\nor for that matter any other benefit of seniority, etc. on<br \/>\nhim. No extension was also granted and he stood<br \/>\nautomatically reverted to his substantive post of ASS and<br \/>\ntherefore, impugned Tribunal order quashing his reversion<br \/>\nand directing his reinstatement was misdirected. Besides<br \/>\nsince regular appointment to the post was to be made by<br \/>\nselection under recruitment rules which did not provide for<br \/>\nregularisation of an ad hoc appointee there was no way to<br \/>\nregularise his services. It is, however, stated that<br \/>\npresently two posts of AAO were available for being filled<br \/>\nup in which he would be accorded due consideration.\n<\/p>\n<p> 4. It is well settled that an appointment to the post<br \/>\nwas to be made in accordance with the mode prescribed by<br \/>\nthe recruitment rules and any appointment made de hors such<br \/>\nrules was not liable to be regularised unless any such<br \/>\nprovision was made by these. Since no such provision<br \/>\nadmittedly existed in the recruitment rules the question of<br \/>\nregularising respondent&#8217;s services would not arise and<br \/>\nTribunal in our view had no occasion to direct<br \/>\nregularisation of respondent&#8217;s services. Impugned Tribunal<br \/>\norder, therefore, can&#8217;t sustain and is set aside.\n<\/p>\n<p> 5. This part, respondent still enjoyed a right of<br \/>\nconsideration for regular promotion to the post of AAO<br \/>\nunder Rules. Now that two posts were admittedly available,<br \/>\npetitioners are directed to accord him due consideration<br \/>\nfor one of the posts and to pass appropriate orders in the<br \/>\nmatter.
