This appeal by<br \/>\nspecial leave  arises from the order of the Punjab &amp; Haryana<br \/>\nHigh Court made on 21.4.1994 in C.R.No.3801\/93. In a suit of<br \/>\nperpetual  injunction\trestraining  the   mother   of\t the<br \/>\nappellants from\t constructing a\t window in  the\t joint\twall<br \/>\nABFAEDC between F &amp; G, the trial Court granted the decree on<br \/>\nthe finding  that 1-1\/2 ft. thick wall was a joint wall and,<br \/>\ntherefore, the\tappellants&#8217; mother  had no  right to  open a<br \/>\nwindow in  the joint  wall. The\t decree\t had  become  final.<br \/>\nSubsequently, the  admitted facts are that 30&#8242; area with the<br \/>\naforesaid zig-zag  wall was  sold to  the  respondent-decree<br \/>\nholders and  the appellants  have constructed straight wall.<br \/>\nThe respondent\tin the\tcross-examination had  admitted that<br \/>\nthe wall  AB is\t 9&#8243; in width. The spot wall FG is also 9&#8243; in<br \/>\nwidth. The  house  was\tconstructed  by\t Surinder  Kumar  in<br \/>\nJanuary 1991.  Wall AB\thas also been constructed afresh. It<br \/>\nwas also  admitted that the wall A to B has been constructed<br \/>\nby Surinder  Kumar  in\this  own  land.\t In  view  of  these<br \/>\nadmissions, it is now clear that the wall B to A is 9&#8243; thick<br \/>\nconstructed by\tthe appellants.\t The only dispute is whether<br \/>\nthe wall  between G  to F  is a\t joint wall.  In view of the<br \/>\nadmission made by the respondents that the present wall F to<br \/>\nG is  also 9&#8243; thick and in view of the fact that there was a<br \/>\nsale made of the land in the zig-zag wall between a new wall<br \/>\nand the\t previous wall\tGFAEDC, the  necessary conclusion is<br \/>\nthat the  joint 1-1\/4  ft. thick wall no longer exists and a<br \/>\nnew wall has been constructed.\n<\/p>\n<p>     The appellants having constructed a new wall admittedly<br \/>\nfrom B\tto A with 9&#8243; width and the wall F and G also with 9&#8243;<br \/>\nwidth, the  necessary conclusion  would be  that the  entire<br \/>\nstraight  wall\t was  constructed   with  9&#8243;  width  by\t the<br \/>\nappellants in  their own  land along with new house in which<br \/>\nnow the window is admittedly opened. It would appear that it<br \/>\nwas closed  due\t to  the  contempt  proceedings\t taken.\t The<br \/>\nquestion  is:\twhether\t the  decree\tpassed\tin  1965  is<br \/>\nexecutable under  Order 21  Rule 32,   CPC.  It says where a<br \/>\nparty against  whom a  decree for  perpetual injunction\t has<br \/>\nbeen passed,  has had  an opportunity  of obeying the decree<br \/>\nand has\t willfully failed  to obey  it, the  decree  may  be<br \/>\nenforced in  the Case  of a  decree for\t injunction  by\t his<br \/>\ndetention in  civil prison  or\tby  the\t attachment  of\t his<br \/>\nproperty or  by\t  both. Though the appellants are successors<br \/>\nin interest,  due to  the fact\tthat  there  is\t an  altered<br \/>\nsituation after\t the decree  was passed\t and the  appellants<br \/>\nhad constructed a separate wall in their own land and opened<br \/>\nthe window,  the decree earlier passed became unenforceable.<br \/>\nTherefore, the execution laid under Order 21 Rule 32, CPC is<br \/>\nunenforceable and cannot be executed.\n<\/p>\n<p>     The court\tbelow, therefore,  were wrong  in proceeding<br \/>\nunder Order  21 Rule  32 CPC to execute decree which did not<br \/>\nexist, It  is contended\t by the respondents that in the sale<br \/>\ndeed executed by the appellant, they have mentioned the wall<br \/>\nto be  the joint  wall. In view of the admission made by the<br \/>\nrespondents in\tthe evidence,  though the  recitals  may  be<br \/>\nthere, the  parties appear  to have  agreed for\t the altered<br \/>\nsituation and in view of the altered situation when previous<br \/>\njoint wall  is admittedly  of 1-1\/2&#8242;  width and the new wall<br \/>\nwith only 9&#8243; width, the appellants have reduced the width of<br \/>\ntheir wall  and opened\tthe window  in their   own  land for<br \/>\nenjoyment of  easement of  necessity of air. Accordingly, we<br \/>\nhold that  the executing  Court\t and  the  High\t Court\twere<br \/>\nclearly in  error in  directing execution  of the old decree<br \/>\nwhich no longer existed and the closure of the window.\n<\/p>\n<p>     The appeal is accordingly allowed.
