HEMA, J.\n       - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 7211 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 27th day of November,2008\n\n                                 O R D E R\n<\/pre>\n<p>      Petition for anticipatory bail.\n<\/p>\n<p>      2. The alleged offence is under sections 509 IPC and 2(b)<\/p>\n<p>and 2(e) of the Prevention of Insults to National Honour<\/p>\n<p>(Amendment) Act, 2003. According to prosecution, a photograph<\/p>\n<p>of a woman appeared in the Mathrhubhumi daily dated 15-8-<\/p>\n<p>2008, in which a woman was wearing an apparel having tri-colour<\/p>\n<p>of Indian National Flag and a complaint was filed that the<\/p>\n<p>advertisement was caused to be published by a jewellery through<\/p>\n<p>a advertising agency and all of them have committed the<\/p>\n<p>offences by use of the portion of the National Flag.<\/p>\n<p>      3. Petitioner is the 2nd accused who is the printer and<\/p>\n<p>publisher of Mathrubhumi daily. Learned counsel for petitioner<\/p>\n<p>submitted that      petitioner is not liable for the advertisement<\/p>\n<p>published in the newspaper because there is another person in<\/p>\n<p>the establishment who is dealing with this section. Petitioner is<\/p>\n<p>not a person who is responsible for receiving and selecting the<\/p>\n<p>advertisement to be published in the                  newspaper. It is also<\/p>\n<p>submitted that the alleged offences are not attracted in this case<\/p>\n<p>and that co-accused were granted anticipatory bail by this Court<\/p>\n<p>as per order dated in B.A. Nos.6697 and 6710\/2008. Therefore,<\/p>\n<p>BA 7211\/08                        -2-\n<\/p>\n<p>anticipatory bail may be granted to petitioner also, it is<\/p>\n<p>submitted.\n<\/p>\n<p>     4. This petition    is strongly opposed. Learned Public<\/p>\n<p>Prosecutor submitted that the expression, &#8216;Indian National Flag&#8217;<\/p>\n<p>is defined in Explanation-2 to Section 2 of the Prevention of<\/p>\n<p>Insults to National Honour Act, 1971. The &#8216;Indian National Flag&#8217;<\/p>\n<p>includes any visible representation of the Indian National Flag or<\/p>\n<p>of any part or parts thereof, made of any substance or<\/p>\n<p>represented on any substance. Any painting, drawing or<\/p>\n<p>photograph also would include the Indian National Flag and it is<\/p>\n<p>not necessary that the Flag as a whole is used to attract the<\/p>\n<p>offence, it is submitted. My attention was also drawn to<\/p>\n<p>Explanation-4 in Section 2, particularly sub-clause (e) which<\/p>\n<p>shows that the disrespect to the Indian National Flag means and<\/p>\n<p>includes use of the National Flag as a portion of costume below<\/p>\n<p>the waist or by embroidering or printing it on cushions,<\/p>\n<p>handkerchiefs, undergarments or any dress material. It is also<\/p>\n<p>submitted that the provision in the Code of India also has to be<\/p>\n<p>read in this context and it is clear that offence under the<\/p>\n<p>Prevention of Insults to National Honour Act is clearly attracted.<\/p>\n<p>     5. It was submitted in B.A.nos.6697 and 6710 of 2008 that<\/p>\n<p>BA 7211\/08                         -3-\n<\/p>\n<p>the three colours were used not on any dress material or dress<\/p>\n<p>or undergarment. It was used in a picture which is published in<\/p>\n<p>an advertisement. Such use of the colours of Indian National<\/p>\n<p>Flag will not come under Explanation-4(e)(ii), it is submitted. As<\/p>\n<p>per the advertisement published in the paper which is subject<\/p>\n<p>matter of this case, it is only made to appear that the colours of<\/p>\n<p>the Indian National Flag are used on a dress material which the<\/p>\n<p>woman had worn but, the colours were not used by petitioners<\/p>\n<p>on any dress material. Those were used for printing an<\/p>\n<p>advertisement, it is submitted.\n<\/p>\n<p>       6. On hearing both sides, I am satisfied that there is a<\/p>\n<p>strong arguable case for both sides. But, if anticipatory bail is<\/p>\n<p>refused, it is likely that petitioners will suffer irreparable injury<\/p>\n<p>and loss, if ultimately a finding is entered, in favour of<\/p>\n<p>petitioners. Hence, I am persuaded to grant anticipatory bail to<\/p>\n<p>petitioners and the following order is passed:-<\/p>\n<blockquote><p>          1)   Petitioner   shall    surrender    before   the<\/p>\n<p>             investigating officer within seven days from<\/p>\n<p>             today and in the event of his arrest, he shall be<\/p>\n<p>             released on bail on his executing bond for<\/p>\n<p>             Rs.25,000\/- with two solvent sureties each for<\/p>\n<p>BA 7211\/08                         -4-\n<\/p><\/blockquote>\n<blockquote><p>            the like sum to the satisfaction of the arresting<\/p>\n<p>            officer, on the following conditions:<\/p>\n<\/blockquote>\n<blockquote><p>             i)     Petitioner shall not tamper with evidence<\/p>\n<p>                    or commit any offence.\n<\/p><\/blockquote>\n<blockquote><p>             ii)    Until an order is passed on merit on the<\/p>\n<p>                    disputed issue, no advertisement, which<\/p>\n<p>                    is the subject matter of this petition,<\/p>\n<p>                    shall be published.\n<\/p><\/blockquote>\n<blockquote><p>     Petition is allowed.\n<\/p><\/blockquote>\n<blockquote><p>                                            K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<blockquote><p>mn.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M.N.
