RAJ KUMAR PASWAN\n                                   Versus\n                             STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p>03\/   19.01.2011           LCR has been received.<\/p>\n<p>                           Both the appellants have been convicted under<\/p>\n<p>                   Sections 147, 148, 302\/149 &amp; 364\/149 of the IPC.<\/p>\n<p>                           Counsel for the appellants submits that the<\/p>\n<p>                   evidence of P.Ws. 1 to 4 shows that deceased was assaulted<\/p>\n<p>                   with lathi, Garasa and pistol, while being taken away by<\/p>\n<p>                   accused persons, has not been supported by the medical<\/p>\n<p>                   evidence and the evidence of P.W. 5, who has conducted the<\/p>\n<p>                   post-mortem of the deceased. Post-mortem report discloses<\/p>\n<p>                   only one injury, caused by throttling of the neck of the<\/p>\n<p>                   deceased. No other external injury was found on the person<\/p>\n<p>                   of the deceased, except swelling of the neck.<\/p>\n<p>                           Considering these facts and also that no specific<\/p>\n<p>                   overt act has been alleged against these two appellants,<\/p>\n<p>                   prayer for bail on behalf of appellants, namely, Kunj Bihari<\/p>\n<p>                   Paswan and Raj Kumar Paswan is allowed.
