Though the matter is posted for_ hearing; on<\/p>\n
I.A., with the consent of the counsel, it is,takenix<\/p>\n
up for final disposal.\n<\/p>\n
2. The facts relevant for the purpose of this’<\/p>\n
revision are as under:\n<\/p>\n
:1; is on   p.m., the
\nExcise Inspector,!HWgEangai\u00a7;\u00a7; ;i had credible
\ninformation”uhen he \ufb01as patroiling duty near Nanthur
\ncross, ,gawii\ufb01aruth;ii\u00a2ari bearing reg. No.CRX 3087
\nproceeding on the Highe\ufb01ay and he chased the car for
\nabout 20d%hmrsi, \ufb02eet ahead and stopped the same.
\nThere Were two oersons in the said car including the<\/p>\n
respondent herein and on search of the vehicle, he<\/p>\n
foundiggfgartons, each containing 48 bottles of 180<\/p>\n
._ ml. aBoss. Whisky, totaling 1152 bottles. The<\/p>\n
“*_respondent and another person had no license or any<\/p>\n
“‘ authority to possess the said liquor. In the<\/p>\n
i”= circumstances, he registered the crime against the<\/p>\n
irespondent and another, held the investigation and<\/p>\n
filed the charge in C.C. No.26097\/1997 in the court<\/p>\n
of JMFC IE1, Mangalore. g\u00e9ixw<\/p>\n

Inc the parallel proceedings for confiscation,
\nthe Authorized Officer issued the notice, continued<\/p>\n
the proceedings and recorded the evidence ofFthex4<\/p>\n
witnesses and on the basis of the said fmateriall.<\/p>\n
confiscated the said Maruthi van;. aggrieved hp then<\/p>\n
said order, the respondent approached the Sessions
\nCourt in Crl.A. No.91\/20d3\u00a9agg the said \u00e9\ufb01peal came’
\nto be allowed by the learned Sessions*Judge on the
\nground that the respondent heieinlnho was one of the
\naccused in C.C: \u00a7o.26U9\u00a7{l$9f has heen acquitted of
\nthe charge 55; the Qiiigce g\u00a2deg”s\u00a2c:ions ii and 14
\nr\/w. 3$y*3% \u00e9n\ufb01\ufb02aezn\ufb02af the Karnataka Excise Act.<\/p>\n
So also no independent witnesses had supported the<\/p>\n
seizure of the liquor and it is on this ground that<\/p>\n
__ the,learned sessions Judge allowed the appeal and<\/p>\n
d:_set,aside–the Order of confiscation. Aggrieved by<\/p>\n
the said Qragr; this revision has been preferred by<\/p>\n
the”State;w\u00b0<\/p>\n
l*3. I have heard the learned Government<\/p>\n
‘fPieader for the petitioner. Yhe respondent though<\/p>\n
lg served is absent.\n<\/p>\n
4. It is relevant to note that for the<\/p>\n
offences punishable under Sections 11 ands 14 r\/w<\/p>\n

32, 34 and 38wA of the Karnataka Excise Act, a
\ncharge sheet came to be filed against the respondent
\nherein in c.c. No.26097\/1997 before the
\nCourt), Mangalore and in the said ‘case: the”
\nprosecution. led the evidence. p’On”\u00abappreciationmfof*
\nthe material on record, the learned \ufb01agistrate has;
\nacquitted the accused on th\u00a7 ground that there is
\ninsufficient evidence for use of-the vehicle for the
\npurpose of transportingi the iliguoiipxr The learned<\/p>\n
Magistrate had =-alsoF””ohserved ijthat attesting<\/p>\n
witnesses for_ the’ seizure_ mahazar did, not support<\/p>\n
the seizure, and Qno” independent witnesses were
\nexamined by the Investigating Officer to prove the<\/p>\n
seizure. u&Q, _it_ is ,on these grounds that the<\/p>\n
_learned Sessions Judge proceeded to allow the appeal<\/p>\n
‘by,setting.aside the Order of confiscation. in my<\/p>\n
considered Vopinion, the Order of the learned<\/p>\n
Sessions Judge is just and proper and as this is a<\/p>\n
” revision, the scope is limited and there cannot be<\/p>\n
re\u00a5appreciation of the evidence except on the ground<\/p>\n
i”ofw_any illegality or perversity in the Order<\/p>\n
