KURDUKAR, J.\n<\/p>\n<p>     The appellants\/accused  have filedthis Criminal Appeal<br \/>\nchallenging  the   Judgment  and  order of  conviction and<br \/>\nsentence passed against them  under Section  302 readwith<br \/>\nSection34  IPCby the Bombay High Court Bench at Aurangabad<br \/>\non September  5, 1990. The first appellant is the husband of<br \/>\nthird appellant and the\t second appellant is their son. The<br \/>\nprosecution case in brief is asunder:\n<\/p>\n<p>(2)  Appa (since  deceased)  was  the  brotherof  A-1 and<br \/>\nChandrakant. In a partition between these three brothers by<br \/>\nmetes and bounds each one was cultivating the land fallen to<br \/>\nhis share.  Their lands are situated  at village Khudawadi,<br \/>\nTaluka Tuljapur in District Osmanabad.There was, however a<br \/>\ndisputebetween Appa and\t A-1 in respect of the location of<br \/>\nfoot track.  OnSeptember  25, 1987 at about 5.00 p.m.,Appa<br \/>\nwas working  inthis  field whereas  his\t daughter,  Sarubai<br \/>\n(P.W.2)was  grazing the\t cattle near  about  the  place\t of<br \/>\nincident. The  appellants were also doing theiragricultural<br \/>\nwork in their own  land. According  tothe  prosecution the<br \/>\nappellants came to the land of Appa and started assaulting<br \/>\nhim with axes and sickle. Sarubai (P.W.2) seeing the assault<br \/>\ncaused by  appellants came  near the  place ofincident and<br \/>\nrequested themnot toassaulther father. A-1and A-2were<br \/>\nassaulting with axes whereas  A-3  was assaulting  with\t a<br \/>\nsickle.Due to this assault Appa fell down and made a signal<br \/>\nto hisdaughter Sarubai\tto go to the abadi and\tcall her<br \/>\nmother Ambubai(P.W.1). Sarubai\t(P.W.2) wentto the house<br \/>\nbut finding  that her  mother was  not there,  she left the<br \/>\nmessagewith her aunt Muktabai,wife ofChandrakant that she<br \/>\nbe informed to come to the field with abullockcart asAppa<br \/>\nwas assaulted  by the  appellants. She then came back to the<br \/>\nplace of  incident. Ambubai  (P.W.1) when returned homefrom<br \/>\nwork, Muktabaiconveyed the  message to\ther and thereafter<br \/>\nshe requested  Shivaji (P.W.4)to geta cart.Shivajithen<br \/>\nbroughtthe  cart fromMaruti and\t then they reached at the<br \/>\nplace of  incident. At that time Appa was bleeding profusely<br \/>\nand was unableto  speak. Sarubai  (P.W.2) told\ther mother<br \/>\nthat the  appellants had  assaulted him. Ambubai and Shivaji<br \/>\nthen put  Appa into  the cart and lift for the dispensary at<br \/>\nNaldurg. Doctor on duty\t declared him dead. Ambubai (P.W.1)<br \/>\nthen went  to  the  police  station  and  lodged  the  first<br \/>\nInformation  Report   (Ex.31)  at  about  10.15 p.m.  After<br \/>\nregistering the FIR the\t investigatingofficerproceeded to<br \/>\nthe hospital and thereafter to the place of incident. During<br \/>\nthe course  of investigation,  statements of various persons<br \/>\ncame to be recorded.  The accused  came to  bearrested\ton<br \/>\n26.9.1987  and in  pursuance of\t their\t statements the<br \/>\nincriminated articles  were  seized.  After  completing the<br \/>\ninvestigation the  appellants were  putup  fortrial for an<br \/>\noffencepunishable under Section 302\/34IPC.<br \/>\n(3)  The appellants  denied the chargeand  claimed  to\tbe<br \/>\ntried. According  to them  theyhave been falsely implicated<br \/>\nin present crime. They had neither goneto the field ofAppa<br \/>\nnor they  had assaulted him. They  pleaded  that  they are<br \/>\ninnocent and beacquitted.\n<\/p>\n<p>(4)  The prosecution  in support  of  its  case principally<br \/>\nrelied upon  the evidence  of eye  witness  Sarubai  (P.W.2)<br \/>\n(minor)aged  about 10 year. Ambubai (P.W.1) Shivaji (P.W.4)<br \/>\nand Shanker  (P.W.5) were the  main witnesses to corroborate<br \/>\nthe evidence  of Sarubai.  The prosecution  also reliedupon<br \/>\nthe various  panchnamasincluding the panchnamas relating to<br \/>\nthe recovery  of incriminatingarticles.\t Dr.Onkar  Swami<br \/>\n(P.W.3)performed the autopsy on the dead body of Appellants<br \/>\ndid notlead any evidence in defence.\n<\/p>\n<p>(5)  The Learned  Sessions Judge  Osmanabad onappraisal of<br \/>\noral and  documentary evidence on record by hisjudgment and<br \/>\norder dated  1.7.1988 convicted the first  appellant  under<br \/>\nSection302  IPC for  committing the  murder  of\t Appa. The<br \/>\nappellants Nos.2  and 3,  however weregiven the benefit of<br \/>\ndoubt and  cameto  be acquitted.  Aggrieved bythe judgment<br \/>\nand order  of conviction  and sentencethe first\t appellant<br \/>\nDattu preferredCriminal AppealNo.352 of 1989 whereas State<br \/>\nof Maharashtrapreferred Criminal  Appeal  No.319  of1988<br \/>\nchallenging the order of acquittal of A-2 and A-3. Both the<br \/>\nappealswere  heard together  and the  DivisionBench of the<br \/>\nHigh Court by its judgment and order dated September 5,1990<br \/>\ndismissed Criminal  Appeal No.352  of 1989  andallowed the<br \/>\nCriminal Appeal No.319of  1988 filled by  the  state and<br \/>\nconvicted A-2  and A-3under Section  302\/34 IPC. It is the<br \/>\njudgment and  order passed  by the  High Courtwhich is the<br \/>\nsubjectmatter of challenge in this appeal.<br \/>\n(6)  The entireprosecution case restedupon the evidence of<br \/>\nSarubai(P.W.2) a child witness aged about 10 years. It is,<br \/>\ntherefore, necessary  to find out as towhetherher evidence<br \/>\nis corroborated from other  evidence on\t record. A child be<br \/>\nthe basis  of conviction. In other words even in the absence<br \/>\nof oath the evidence  of a  child witness can be considered<br \/>\nunder Section  118 of  the evidence  Act provided  thatsuch<br \/>\nwitnessis  able to understand the question andable togive<br \/>\nrational answers  thereof. Theevidence of  a child witness<br \/>\nand credibility thereof would depend upon the circumstances<br \/>\nof each case. case.  The onlyprecaution which  the  court<br \/>\nshould bear  inmind while assessing the evidence of a child<br \/>\nwitnessis  that the  witness must  reliable one and his\/her<br \/>\ndemeanour must be like any other competent witness and there<br \/>\nis no likelihood of being tutored. There is no practicethat<br \/>\nin every case the evidence of such a witness becorroborated<br \/>\nbefore a  conviction can be allowed to stand but, however as<br \/>\na ruleof prudence  the courtalways finds itdesirable to<br \/>\nhave  the   corroboration  tosuch  evidence from  other<br \/>\ndependable evidence  onrecord. In the light of\tthiswell<br \/>\nsettledprinciple we may proceed to consider the evidence of<br \/>\nSarubai(P.W.2).\n<\/p>\n<p>(7)  The learned  trialjudge recorded his reasons and found<br \/>\nthat Sarubai  was a  competent witnessand her evidence is<br \/>\nunblemished. The  High Court  also accepted  the evidence of<br \/>\nSarubaias  reliable one.  We, therefore,  do  not  see any<br \/>\nreason to  disagree with  the observations  ofthe  learned<br \/>\ncourts below  as regards  the evidenceof Sarubai  Wewere<br \/>\ntaken through  the judgments  of the courts below as regards<br \/>\nthe evidence  of Sarubai  We were takenthough the judgments<br \/>\nof thecourts below aswell asthe evidence ofSarubai. She<br \/>\nhad stated  in her  evidence that  whenshe  was grazing the<br \/>\ncattle in  the field  at  about 5.00  p.m,  all\t the  three<br \/>\nappellants camein her land andstartedassaulting Appa(her<br \/>\nfather). A-1  and A-2  had axesin their hands while A-3 was<br \/>\nhaving a  sickle in  her hand. On seeing a ghastly attack on<br \/>\nher father she was verymuch scared, Appa then made a signal<br \/>\nto herto go  the  abadi\t andinformthe  mother  Ambubai<br \/>\n(P.W.1). She then immediately proceededtowardsabadi and on<br \/>\nthe way she saw\t Shanker (P.W.5)  who was  working  in his<br \/>\nfield. After reaching home she found that her mother had not<br \/>\nreturned from the work and, therefore, left themessagewith<br \/>\nMukta, the aunt, about the assault on Appa and requested her<br \/>\nto askher mother Ambubai (P.W.1) to reach thefield with a<br \/>\nbullockcart. Sarubai (P.W.2)  then returned tothe place of<br \/>\nincident. In the mean time Ambubai (P.W.1) who returnedfrom<br \/>\nthe work  got the  message andrequested Shivaji (P.W.4) to<br \/>\nget the cart. Shivaji(P.W.4)then  brought  the\tcart  of<br \/>\nMaruti in  which they  reached at  theplace  of\t incident.<br \/>\nSarubai(P.W.2) narrated the  entire  incident to  Ambubai<br \/>\n(P.W.1). Appa  was then kept in\t the chart andwas taken to<br \/>\nthe dispensaryat Naldurg. Doctor on duty, however declared<br \/>\nhim dead.  We have  carefully examinedthe evidence ofthis<br \/>\nwitnessand we find that it is totally unblemished. There is<br \/>\nno challenge  to her  evidence that  she was inthe field at<br \/>\nthe time  of incident. Her evidence finds corroborationfrom<br \/>\nShanker(P.W.5)who hadstated that when he wasin his field<br \/>\nhe heard  commotion inthe field\t of Appa  andafter  going<br \/>\nthere he  saw sarubai  also in the field. Ambubai (P.W.1) in<br \/>\nher evidence  stated that  her daughter sarubai (P.W.2) had<br \/>\ngone to the field along with her father and she herself had<br \/>\ngone towork inanotherfield. When shereturned home in the<br \/>\neveningshe  got a  message from\t Muktabai about the assault<br \/>\nand toget a bullock cart in the field. Shivaji (P.W.4) has<br \/>\nalso stated  onoath  that when he received  amessagefrom<br \/>\nAmbubaito  geta\t carthe\t gotthe\t same  from Maruti and<br \/>\nthereafter he and Ambubai went to the field. Sarubai (P.W.2)<br \/>\nthen narrated  the incident  toher  mother. Appa  wasthen<br \/>\ntaken to the dispensaryat Naldurg in the bullock cart where<br \/>\nhe wasdeclared dead  by\t theMedical officer.  From the<br \/>\nevidence of  these witnesses  it is  clear  that  all  these<br \/>\nmovements tookplace in\ta very\tshortspan oftime because<br \/>\nthey reached  the  dispensary  at  Naldurg  which  is  at  a<br \/>\ndistance of  15kms., from Khudawadi  at about 9.30 p.m.\t or<br \/>\n10.00 P.m.  We,therefore,  seeno  hesitation in confirming<br \/>\nthe findings ofthe courts below that Sarubai was present in<br \/>\nthe field alongwith her fatherat the time of incident.<br \/>\n(8)  The second circumstance which  lends corroboration\t to<br \/>\nthe evidence  of Sarubai  (P.W.2) is  that Ambubai(P.W.1) in<br \/>\nher First  information Report lodged at10.15 p.m. had given<br \/>\nout the names of  all the three appellants as assailants of<br \/>\nAppa. Althoughit was contended on behalf of the appellants<br \/>\nthat the  evidence  ofSarubai (P.W.2)  is  concocted and<br \/>\nunreliable butwe seeno substance inthis contention. Dr.<br \/>\nOnkar Swami (P.W.3) whoheld the autopsy on thedead body of<br \/>\nAppa noted  16 injuries on thedead body of Appa. He stated<br \/>\nthat these injuries were possible by three different weapons<br \/>\nand not by one weapon. It  is needless\tto  set\t out the<br \/>\nevidence of  Dr. Onkar in detail since there isno challenge<br \/>\nto thefact that\t Appamet  with a  homicidal death  due to<br \/>\ninjuries on  his person.  The evidenceof Dr. Onkar (P.W.3)<br \/>\ncorroborates the evidence of Sarubai (P.W.2) when she stated<br \/>\nthat A-1  and A-2 had assaultedher father withaxes and A-3<br \/>\nwith asickle.Out  ofthese 16 injuries as many as 10were<br \/>\nincisedwoundsand injury\t No.3 was  curved lacerated wound<br \/>\nwhich was  attributableto A-3.Having regards to the nature<br \/>\nand the size of\t theseinjuries\twe have no manner of doubt<br \/>\nthat this  ghastly attack couldnot be caused by one person.<br \/>\nThe High  Courtin our considered view rightly held that the<br \/>\nmedical evidence   corroborates\t the  evidence of  Sarubai<br \/>\n(P.W.2).\n<\/p>\n<p>(9)  Inaddition\t to  the  above\t substantive  evidence the<br \/>\nprosecution also  relied upon  the circumstantial  evidence,<br \/>\nnamely,recovery\t of certain incriminating articles. Clothes<br \/>\nof theaccusedwere  seized under\t panchnama Ex.55 andthis<br \/>\npanchnama is  proved by panch witnesses\t Ajmoddin (P.W.10).<br \/>\nDhoti and  cap of A-1 were sentto the chemicalanalyser and<br \/>\nhis report  is at  Ex.28, wherein  it is statedthat the cap<br \/>\nhad human  bloodstains of  blood groupA whichwas thesame<br \/>\nblood group  ofthe  deceased. The blood group of A-1 is AB.<br \/>\nThis weapons  like axes and asickle were  claimed tohave<br \/>\nbeen recovered at the instance of appellants pursuant to the<br \/>\nstatement made under Section 27of the EvidenceAct butthis<br \/>\nevidence was  not accepted  by the trial court and we do not<br \/>\nproposeto accept the same.\n<\/p>\n<p>(10) After going  through the judgmentsof thecourts below<br \/>\nwe are satisfied that the high Court  was fullyjustified in<br \/>\nreversing theorder of acquittal passed by the trial court<br \/>\nas regards  A-2and  A-3 .  Thehigh Court was also right in<br \/>\nupholding the conviction of A-1.\n<\/p>\n<p>(11) Inthe   result  there isno substance inthe criminal<br \/>\nappeal and  it is  accordingly dismissed.
