Justice K.T.SANKARAN\n\n Dated :03\/06\/2009\n\n O R D E R\n                           K.T.SANKARAN, J.\n                       ------------------------------\n                          B.A.No.2888 of 2009\n                       -----------------------------\n                  Dated this the 3rd day of June, 2009\n\n\n                                   ORDER\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure.\n<\/p>\n<p>      2. The offence alleged against the petitioners is under Section<\/p>\n<p>498A read with Section 34 of the Indian Penal Code.<\/p>\n<p>      3. The learned public prosecutor submitted that the petitioners 2<\/p>\n<p>to 4 were deleted from the array of accused and the first petitioner<\/p>\n<p>alone is the accused in Crime No.184 of 2009 of Bekal Police Station.<\/p>\n<p>      4. Taking into account the facts and circumstances of the case,<\/p>\n<p>the nature of the offence and other circumstances, I am of the view<\/p>\n<p>that anticipatory bail can be granted to the first petitioner. There will<\/p>\n<p>be a direction that in the event of the arrest of the first petitioner, the<\/p>\n<p>officer in charge of the police station shall release him on bail for a<\/p>\n<p>period of one month on his executing bond for Rs.25,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<p>a)    The first petitioner shall report before the investigating officer<br \/>\n      between 9 A.M.       and 11 A.M. on all Mondays, till the final<br \/>\n      report is filed or until further orders;<\/p>\n<p><span class=\"hidden_text\">BA No.2888\/2009                     2<\/span><\/p>\n<p>b)   The first petitioner shall appear before the investigating officer<br \/>\n     for interrogation as and when required;<\/p>\n<p>c)   The first petitioner shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;<\/p>\n<p>d)   The first petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>e)   On the expiry of the period mentioned above, the first petitioner<br \/>\n     shall surrender before the Magistrate concerned and seek regular<br \/>\n     bail;\n<\/p>\n<p>f)   In case of breach of any of the conditions mentioned above, the<br \/>\n     bail shall be liable to be cancelled.\n<\/p>\n<p>\n     The Bail Application is allowed to the extent indicated above.<\/p>\n<p>                                                 K.T.SANKARAN,<br \/>\n                                                     JUDGE<br \/>\ncsl<\/p>\n<p><span class=\"hidden_text\">BA No.2888\/2009    3<\/span><\/p>\n<p>                        K.T.SANKARAN,<br \/>\n                          JUDGE<br \/>\ncsl<\/p>\n<p><span class=\"hidden_text\">BA No.2888\/2009    4<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Murali.N.
