And others.\n\n\n\n\n22.6.2010.\n\n       Shri Shreyas Dharmadhikari, counsel for the petitioner.\n       Shri      Sudesh    Verma,   Government      Advocate     for\nrespondents 1,2 and 3.<\/pre>\n<p>       This case was listed on 21.5.2010 on which date notices<br \/>\nwere issued and the learned Additional Advocate General made a<br \/>\nstatement before this Court that issue with regard to amendment<br \/>\nof Rule 3(2) of Madhya Pradesh (Prevention of Illegal Mining,<br \/>\nTransportation and Storage) Rules, 2006 is under consideration<br \/>\nwith the State Government. He prayed for three weeks&#8217; time to<br \/>\nenable him to seek instructions in the matter and to file return, if<br \/>\nso advised. Thereafter the case was listed on 17.6.2010 and on<br \/>\nthat date the case was directed to be listed on 21.6.2010. As<br \/>\ndirected earlier, on 21.6.2010, the Govt. Advocate was again<br \/>\ndirected to seek instruction from the respondents in respect of<br \/>\nstatement made by the Additional Advocate General before this<br \/>\nCourt on 21.5.2010.\n<\/p>\n<p>       Today, Shri Verma submitted that the Secretary of the<br \/>\nDepartment is out of the country and is unable to make any<br \/>\nstatement. In these circumstances, we are left with no option<br \/>\nexcept to direct the Principal Secretary of the Department to<br \/>\nremain personally present before this Court on 23.6.2010 at 10.30<br \/>\na.m.\n<\/p>\n<p>       The learned Govt. Advocate submitted that he shall secure<br \/>\npresence of the Principal Secretary of the Department on<br \/>\n23.6.2010.\n<\/p>\n<p>       In view of the aforesaid, the petition is adjourned for<br \/>\n23.6.2010 and the case shall be taken up at 10.30 a.m.<br \/>\n       A typed copy of this order be supplied to Shri       Sudesh<br \/>\nVarma for its transmission and compliance by the concerned<br \/>\nofficer.\n<\/p>\n<p>                                 W.P.No.6833\/2010<\/p>\n<p>             Ashukant Jain                 State of M.P.
