Heard the learned counsel for the appellant<\/p>\n<p>                    on the interlocutory application No.2710 of 1998<\/p>\n<p>                    and the interlocutory application No.8315 of 1997.<\/p>\n<p>                              The interlocutory application No.2710 of<\/p>\n<p>                    1998 has been filed for substitution of the legal<\/p>\n<p>                    representatives of the deceased respondent No.7,<\/p>\n<p>                    namely, Mano Devi.            Since, there was delay in<\/p>\n<p>                    filing   the   substitution        application,   prayer   for<\/p>\n<p>                    condoning the delay and setting aside abatement<\/p>\n<p>                    has been made.           Notices were issued to the<\/p>\n<p>                    proposed heirs of the deceased respondent No.7.<\/p>\n<p>                    In spite of service of notice, none of the legal<\/p>\n<p>                    representatives have          appeared to oppose           the<\/p>\n<p>                    prayer.\n<\/p>\n<p>                              In   view     of     the      above     facts    and<\/p>\n<p>                    circumstances of the case, the delay in filing the<\/p>\n<p>                    substitution application is condoned, abatement is<\/p>\n<p>                    set aside and the interlocutory application No.2710<\/p>\n<p>                    of 1998 is allowed.          The legal representatives as<\/p>\n<p>                    mentioned      in   detail    in     paragraph    3   of   the<\/p>\n<p>                    substitution application are substituted in place of<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>            the deceased respondent No.7.\n<\/p>\n<p>                        So far I.A. No.8315 of 1997 is concerned,<\/p>\n<p>            it is also a substitution application for substitution<\/p>\n<p>            of    the   legal       representatives    of   the   deceased<\/p>\n<p>            respondent No.3, namely, Basudeo Sao,                   and in<\/p>\n<p>            this application also prayer for condoning the delay<\/p>\n<p>            has been made.             In spite of service of notice in<\/p>\n<p>            substitution matter, the proposed heirs have not<\/p>\n<p>            appeared to oppose the substitution application.<\/p>\n<p>            Accordingly, the delay in filing the substitution<\/p>\n<p>            application is condoned, abatement is set aside and<\/p>\n<p>            the interlocutory application No.8315 of 1997 is<\/p>\n<p>            allowed.
