Justice V.GIRI\n\n Dated :01\/12\/2008\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                  W.P.(C).28753\/2008\n                      --------------------\n       Dated this the 1st day of December, 2008\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner challenges Ext.P7 order passed by the<\/p>\n<p>Kerala State Human Rights Commissioner as early as<\/p>\n<p>on 13.5.2002.     By the said order,        Human Rights<\/p>\n<p>Commission noting that the petitioner was not present<\/p>\n<p>before the Commission, had dismissed his complaint<\/p>\n<p>for default. I had requested the learned counsel for the<\/p>\n<p>petitioner to get instructions as to why there was such<\/p>\n<p>extensive delay on the part of the petitioner, in<\/p>\n<p>approaching this Court, challenging Ext.P7 which was<\/p>\n<p>passed on 13.5.2002.\n<\/p>\n<\/p>\n<p>2.    An additional affidavit has been filed by the<\/p>\n<p>petitioner explaining the reasons which allegedly<\/p>\n<p>contributed to the delay, on 17.11.2008. I have gone<\/p>\n<p>through the said affidavit and in paragraph 5 thereof,<\/p>\n<p>petitioner aged 46, submits that if his memory is<\/p>\n<p>correct, he has personally gone and enquired about<\/p>\n<p>the follow up of his complaint in the office of the<\/p>\n<p>Commission in the year 2003 and that he was directed<\/p>\n<p>W.P.(C).28753\/2008<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>to contact over telephone to ascertain the position of his<\/p>\n<p>complaint and he used to contact at least once in a<\/p>\n<p>month. It seems that the petitioner continued to do so<\/p>\n<p>for more than four years.         He is seen to have filed<\/p>\n<p>Ext.P11 complaint on 1.6.2007.\n<\/p>\n<\/p>\n<p>3.   I am unable to accept the reason put forward by<\/p>\n<p>the petitioner, attempting to explain the gross delay in<\/p>\n<p>having approached this Court challenging Ext.P7 order.<\/p>\n<p>Remedy of the petitioner should have been to first<\/p>\n<p>approach the Commission pointing out the reasons for<\/p>\n<p>his absence on 13.5.2002. That is also not seen to have<\/p>\n<p>been done within a reasonable time.                 There is<\/p>\n<p>unexplained delay and lapse on the part of the petitioner.<\/p>\n<p>I do not think this is a fit case to invoke the extraordinary<\/p>\n<p>jurisdiction of this Court under Article         226 of the<\/p>\n<p>Constitution of India.
