Sy.NO.140\/7 measuring 1.07\n\n WA\u20ac:res and Sy.NO.1-40\/8 measuring 0.44 Cents, situated\n\n at Hirebandadi viiiage Of Puttur Taluk. He has been\n\n\n\ncultivating the said land as a tenant. After coming into\n\nforce of the Karnataka Land Reforms Act (for sphortdthe\n\n'Act'), he made an application under F\n\nConferrnent of occupancy right   \n\nSy.No.140\/1 and sy.No.14o\/7,  \n\nTribunal and conferred occupancy right  the r L'\n\npetitioner and the sarne has.:vb'e.corne  Vpfiiowever,\nthe petitioner V in respect of\nSy.No.140\/8 'V he was\ncultivating    for more than\n40 yeardsfv    amendment of the\nKarnataka by answering Section\n\n77--A_ of theu\ufb01ct,' theipedtitioner fiied Form No.7 claiming\n\n,,rightfV""for grant of Land in respect of\n\ni.f4'Qv\/'\u00e9f-eneasuring 0.44 cents. The said\n\napplicatvionidwias fiied on 15\/ 12\/ 1998. However, the said\n\n Vdppoppylicdation was rejected by the competent authority i.e.,\n\n   respondent by an order dated 4\/9\/2001 and<\/pre>\n
 being aggrieved by the same, petitioner filed<\/p>\n

matter was transferred to KAT since appeal was<\/p>\n
provided against the order passed on an applicaltiion<\/p>\n

\nTribunal,   petitioner could not
\n\ufb01le ap\u00abrp1i\u00a2ae\u00e9;n   occupancy right in
\nrespec\u00a7\u00a3:L,;,i:ll 773A of the Act gave<\/p>\n
him right” to file a:r1_ha.pplicat.ion and petitioner had<\/p>\n
. it”proved3–.’that._he Waslla tenant of the said land as on<\/p>\n
“hu.tr.~he could not file an application for<\/p>\n
conferrr_1ent) of occupancy right before the 15′-<\/p>\n

  applieation filed by the petitioner and the learned Single<\/p>\n
  -Judge was not justified in confirming the finding of the<\/p>\n
V Tribunal and confirming the order passed by the lei<\/p>\n

respondent and therefore sought for quashing of the<\/p>\n
order passed by the Tribunal.\n<\/p>\n
3. Learned Single Judge by an  _<\/p>\n

for respondent No.1 and the “learned counsvelliwgngpeagring <\/p>\n
for respondent No.2 held that\/the’petitioner  failed
\nto make an application.  _ for grant of
\noccupancy rightin  that he was
\nin possession”ofi0AIft}:i’e larid  tenant and made an
\napplication’for”‘co’ni’errrierit..o’f occupancy right in respect<\/p>\n
of Sy.No.l”-7-l_0\/pl and’.:140_'[*~8 even though Sy.No.140\/8 is<\/p>\n
 adjaeent’to the-“s-aid___land and the petitioner had failed to<\/p>\n
 \u00bbpro*.re that was a tenant of the land as on 1\/ 3 \/ 1974<\/p>\n
 declined to interfere with the impugned<\/p>\n
 order  “dismissed the writ petition. Being aggrieved<\/p>\n
2′ the order of dismissal dated 5\/2\/2009 petitioner<\/p>\n
   preferred this appeal.\n<\/p>\n

4. We have heard the learned counsel appearing
\nfor the appellant and the learned Govt. Advocate<\/p>\n
appearing for respondent No. 1.\n<\/p>\n

failed to  in Form No.7 for grant of<\/p>\n

 respondent. No.1 and the Appellate<\/p>\n

appellant and the learned Govt. Advocate <\/p>\n
the respondent No.1 and scrutinized    <\/p>\n
record in the light of the decision<\/p>\n

8. The scrutiny’ of   would

\nlands in Sy;N\\o.1\u00e9l0\/’:l– if   1.04 Acres,
\nSy.No. 140g   ijA\u00a2l~;\u00a7ssi’lland Sy.No. 140\/8<\/p>\n

 final,  the petitioner failed to file an application<\/p>\n

entries in the R.O.R. do not support the contention of<\/p>\n
the petitioner that he is a tenant of the land in<\/p>\n

petitioner has not lead any evidence to substantiatehhis<\/p>\n
contention that he was cultivating the  .<\/p>\n
