Justice M.C.HARI RANI\n\n Dated :30\/06\/2008\n\n O R D E R\n                         K.BALAKRISHNAN NAIR &amp;\n\n                            M.C.HARI RANI, JJ.\n\n                     -----------------------------------------\n\n                      W.P.(C) NO. 13586 OF 2008-P\n\n                     -----------------------------------------\n\n                           Dated 30th June, 2008.\n\n                                 JUDGMENT\n<\/pre>\n<p>Balakrishnan Nair, J.\n<\/p>\n<p>      After hearing both sides, we passed the following interim order in this<\/p>\n<p>writ petition:\n<\/p>\n<blockquote><p>      &#8220;Heard. The petitioner is a Jama-ath consisting of more than<br \/>\n      200 families. They submit 14 families broke away from the<br \/>\n      Jama-ath and has formed a rival Jama-ath, the 4th respondent.<br \/>\n      According to the petitioner, the 4th respondent is supporting<br \/>\n      fundamentalism and giving training to young people, in arms.<br \/>\n      Their activities are a threat to religious amity in the area. They<br \/>\n      have attacked the members of the petitioner on 15.4.2008 and a<br \/>\n      crime has been registered against them for the commission of<br \/>\n      offences, including the one under Section 308 IPC. Their threat<br \/>\n      is continuing even now.       Therefore, the petitioner prays for<br \/>\n      necessary police protection.\n<\/p><\/blockquote>\n<blockquote><p>             2.  The 4th respondent has filed a counter affidavit,<br \/>\n      denying all the allegations against them. The said respondent<br \/>\n      points out that at present 45 families are its members. They say,<br \/>\n      they are not spreading any fundamentalism and they are not<br \/>\n      giving training to the youth, in arms. The 2nd respondent has<br \/>\n      filed a counter affidavit, in which it is submitted that two cases<br \/>\n      have been registered as case and counter case against both<br \/>\n      factions and police patrolling is provided in the area to prevent<br \/>\n      communal clash. The additional 5th respondent prayed for two<br \/>\n      weeks time to file a statement as directed by the Court.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">WPC 13586\/08                          2<\/span><\/p>\n<blockquote><p>            Having regard to the facts of the case, the police is<br \/>\n      directed to continue its surveillance in the area.        If any<br \/>\n      complaint is received regarding threat or commission of a<br \/>\n      cognizable offence, the police shall properly enquire into the<br \/>\n      same and take effective steps to maintain law and order.&#8221;\n<\/p><\/blockquote>\n<p>In view of the above interim order, no further orders are required in this<\/p>\n<p>Writ Petition.
