SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/04\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tPresent<br \/>\nRevision Application under section 29(2) of the Bombay Rent Act has<br \/>\nbeen preferred by the applicant herein   original defendant to<br \/>\nquash and set aside judgment and decree dated 12.02.2001 passed by<br \/>\nthe learned Civil Judge (J.D.), Jetpur in Regular Civil Suit No.25 of<br \/>\n1996 by which learned Trial Court has passed decree of possession in<br \/>\nfavour of landlord which came to be confirmed by the learned<br \/>\nAppellate Court by impugned order 24.03.2008 in Regular Civil appeal<br \/>\nNo.16 of 2001.\n<\/p>\n<p>2.\t\tRespondent<br \/>\nherein   original plaintiff  instituted Regular Civil Suit No.25 of<br \/>\n1997 in the Court of learned Civil Judge (J.D.), Jetpur for decree of<br \/>\npossession on the ground of arrears of rent by the tenant for more<br \/>\nthan 6(six) months and also for recovery of arrears of rent of<br \/>\nRs.8820.60 due and payable from 06.12.1992. It was the case on behalf<br \/>\nof the plaintiff that despite service of statutory notice and notice<br \/>\nterminating tenancy, tenant did not pay arrears of rent.  It was the<br \/>\ncase on behalf of the tenant that there was no arrears of rent and<br \/>\nlandlord did not issue any receipt though rent was paid.  That the<br \/>\nlearned Trial Court after framing necessary issues at Exh.43 and<br \/>\nafter appreciation of evidence on record by judgment and decree dated<br \/>\n12.02.2001 passed eviction decree directing applicant to hand over<br \/>\npeaceful and vacant possession of suit premises and also directed<br \/>\napplicant   tenant to pay Rs.8820.60 being arrears of rent. Being<br \/>\naggrieved and dissatisfied with the judgment and decree dated<br \/>\n12.02.2001 passed by the learned Trial Court in Regular Civil Suit<br \/>\nNo.25 of 1996, applicant   original defendant no.1 preferred<br \/>\nRegular Civil Appeal No.16 of 2001 before the District Court, Rajkot<br \/>\nand learned Appellate Court I.e. Presiding Officer and 6th<br \/>\nFast Track Court, Gondal Camp, Jetpur by impugned order dated<br \/>\n24.03.2008 dismissed the appeal confirming the judgment and decree<br \/>\npassed by the learned Trial Court. Being aggrieved and dissatisfied<br \/>\nwith judgment and order passed by both the Courts below in passing<br \/>\neviction decree against the applicant   tenant on the ground of<br \/>\narrears of rent for more than 6(six) months, applicant   original<br \/>\ndefendant has preferred present Revision Application under section<br \/>\n115 of the Code of Civil Procedure.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard Mr.Nangesh, learned Advocate for the applicant and Mr.Dave,<br \/>\nlearned Advocate appearing for Mr.Trivedi, learned Advocate appearing<br \/>\nfor the respondent herein   original plaintiff  and considering<br \/>\nimpugned judgment and orders passed by both the Courts below it<br \/>\ncannot be said both the Courts below have committed any illegality in<br \/>\npassing eviction decree against the applicant   tenant on the<br \/>\nground of arrears of rent for more than 6(six) months. As such there<br \/>\nare concurrent findings given by both the Courts below holding that<br \/>\napplicant has failed to prove that he has paid rent due and payable<br \/>\nto the landlord. Both the Courts below have concurrently found<br \/>\nagainst applicant   tenant in not paying arrears of rent for more<br \/>\nthan 6(six) months and has given finding that despite statutory<br \/>\nnotice applicant tenant has failed to pay arrears of rent.  Finding<br \/>\nof facts given by both the Courts below are on appreciation of<br \/>\nevidence which are not required to be re-appreciated and\/or<br \/>\ninterfered with by this Court in exercise of revisional jurisdiction<br \/>\nunder section 29(2) of the Bombay Rent Act. Learned Advocate for the<br \/>\napplicant -tenant has failed to point out any infirmity in the<br \/>\njudgment and order passed by both  the Courts below which calls for<br \/>\ninterference of this Court in exercise of powers under section 29(2)<br \/>\nof the Bombay Rent Act.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of above,  there is no substance in the present Revision<br \/>\nApplication which deserves to be dismissed and accordingly it is<br \/>\ndismissed.
