Kodekar, learned APP waives service of notice of rule on<br \/>\nbehalf of respondent no. 1 and Shri Premal Ranchh, learned advocate<br \/>\nwaives service of notice of rule on behalf of respondent no.<br \/>\n2-original complainant.\n<\/p>\n<p>3.\tIn<br \/>\nthe facts and circumstances of the case and with the consent of the<br \/>\nlearned advocates appearing on behalf of the respective parties, the<br \/>\npresent application is taken up for final hearing today.\n<\/p>\n<p>4.\tThe<br \/>\npresent application under Section 482 of the Code of Criminal<br \/>\nProcedure has been preferred by the applicant-original<br \/>\naccused-convict for the following reliefs;\n<\/p>\n<p>(A)\tYour<br \/>\nLordships may be pleased to allow the Miscellaneous Criminal<br \/>\nApplication and be further pleased to recall  the order of this<br \/>\nHon&#8217;ble Court dated 25\/11\/2010 passed in Criminal Revision<br \/>\nApplication No. 619\/2009 in view of the compromise arrived at between<br \/>\nthe parties; and further be pleased to acquit the applicant-accused<br \/>\nby quashing and setting aside the judgment and order dated 12\/07\/2005<br \/>\npassed in Criminal Case No. 581\/2002 as well as the judgment and<br \/>\norder dated 30\/06\/2009 passed in Criminal Appeal No. 26\/2005.\n<\/p>\n<p>(AA)\tYour<br \/>\nLordships may be pleased to grant permission of compounding of the<br \/>\noffence in view of the subsequent development of compromise arrived<br \/>\nat between the parties after the judgment is delivered in Criminal<br \/>\nRevision Application No. 619\/2009 and thereby pleased to quash and<br \/>\nset aside the judgment and order dated 12\/07\/2005 passed in Criminal<br \/>\nCase No. 581\/2002, judgment and order dated 30\/06\/2009 passed in<br \/>\nCriminal Appeal No. 26\/2005 as well as the judgment and order dated<br \/>\n25\/11\/2010 of this Hon&#8217;ble Court passed in Criminal Revision<br \/>\nApplication No. 619\/2009 and further be pleased to acquit the<br \/>\napplicant\/accused;\n<\/p>\n<p>5.\tShri<br \/>\nTushar Sheth, learned advocate appearing on behalf of the<br \/>\napplicant-original accused-convict has submitted that subsequent to<br \/>\nthe order passed by this Court dated 25\/11\/2010 in Criminal Revision<br \/>\nApplication No. 619\/2009 confirming the orders passed by both the<br \/>\nCourts below convicting the applicant for the offence punishable<br \/>\nunder Section 138 of the Negotiable Instruments Act, there is a<br \/>\nsettlement arrived at between the applicant and respondent no. 2  by<br \/>\nwhich  the  applicant has agreed to pay a total sum of Rs. 75,000\/-,<br \/>\nwhich is the cheque amount, and in fact the said amount is already<br \/>\npaid to respondent no. 2, and, therefore, it is requested to permit<br \/>\nthe applicant to compound the offence and consequently to quash and<br \/>\nset aside the order of conviction recorded by the learned trial Court<br \/>\nconfirmed by the learned Sessions Court as well as this Court.  Shri<br \/>\nTushar Sheth, learned advocate appearing on behalf of the applicant<br \/>\nhas relied upon the decision of the learned Single Judge of this<br \/>\nCourt in the case of KIRPALSINGH PRATAPSINGH Vs. SALVINDER KAUR<br \/>\nHARDISINGH LOBANA reported in 2004 (2) GLH 544.  Relying<br \/>\nupon the said decision, it is submitted that even after dismissal of<br \/>\nCriminal Revision Application confirming the conviction by both the<br \/>\nCourts below, compounding of the offence is permissible, more<br \/>\nparticularly, in cases under the Negotiable Instruments Act.  Shri<br \/>\nTushar Sheth, learned advocate appearing on behalf of the applicant<br \/>\nhas further submitted that he has brought the Demand Draft in the<br \/>\nname of Gujarat State Legal Services Authority for an amount of Rs.<br \/>\n10,000\/-, which is required to be deposited as per the decision of<br \/>\nthe Hon&#8217;ble Supreme Court in the case of DAMODAR S. PRABHU Vs.<br \/>\nSAYED BABALAL H. reported in (2010) 5 SCC 663 while<br \/>\npermitting the parties to compound the offence.  He has submitted<br \/>\nthat the Demand Draft shall be deposited with the Gujarat State Legal<br \/>\nServices Authority during the course of the day.\n<\/p>\n<p>6.\tShri<br \/>\nPremal Ranchh, learned advocate appearing on behalf of respondent no.<br \/>\n2, under instructions from respondent no. 2, has stated at the bar<br \/>\nthat respondent no. 2 has no objection in permitting the applicant to<br \/>\ncompound the offence and quashing and setting aside the order of<br \/>\nconviction recorded by the learned trial Court  and the learned<br \/>\nSession Court confirmed by this Court.  He has also stated at the<br \/>\nbar, under instructions from respondent no. 2, that he has already<br \/>\nreceived a sum of Rs. 75,000\/- from the applicant being the cheque<br \/>\namount.\n<\/p>\n<p>7.\tShri<br \/>\nR.C. Kodekar, learned APP has requested to pass an appropriate order<br \/>\nconsidering the aforesaid decisions of the Hon&#8217;ble Supreme Court as<br \/>\nwell as this Court in the facts and circumstances of the case<br \/>\nrecorded hereinabove.\n<\/p>\n<p>8.\tIn<br \/>\nview of the above and considering the fact that as the parties have<br \/>\nnow settled the dispute amicably and the cheque amount is already<br \/>\npaid by the applicant to respondent no. 2 and the applicant has also<br \/>\ndeposited a sum of Rs. 10,000\/- with the Gujarat State Legal Services<br \/>\nAuthority to be deposited as per the decision of the Hon&#8217;ble Supreme<br \/>\nCourt in the case of DAMODAR S. PRABHU (Supra) to be deposited<br \/>\nwhile permitting the applicant to compound the offence and<br \/>\nconsidering the decision of the learned Single Judge of this Court in<br \/>\nthe case of KIRPALSINGH PRATAPSINGH (Supra) and as neither the<br \/>\nlearned APP nor the learned advocate appearing on behalf of<br \/>\nrespondent no. 2, under instructions from his client, have no<br \/>\nobjection in permitting the applicant to compound the offence for<br \/>\nwhich the applicant is convicted for the offence punishable under<br \/>\nSection 138 of the Negotiable Instruments Act,  applicant is<br \/>\npermitted to compound the offence for which he is convicted and<br \/>\nconsequently the order of conviction passed by the learned trial<br \/>\nCourt dated 12\/07\/2005 in Criminal Case No. 581\/2002 and the order<br \/>\npassed by the learned Sessions Court dated 30\/06\/2009 in Criminal<br \/>\nAppeal No. 26\/2005 confirmed by this Court in Criminal Revision<br \/>\nApplication No. 619\/2009 are hereby quashed and set aside.\n<\/p>\n<p>9.\tWith<br \/>\nthis, the present application is allowed.  Rule is made absolute to<br \/>\nthe aforesaid extent.
