Counter\u00a0and\u00a0rejoinder\u00a0has\u00a0been\u00a0exchanged\u00a0between\u00a0the\u00a0parties\u00a0and\u00a0the\u00a0writ\u00a0<br \/>\n          petition\u00a0is\u00a0heard\u00a0finally\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0two\u00a0petitioners,\u00a0namely,\u00a0Sidheshwar\u00a0Singh\u00a0<br \/>\n          S\/o\u00a0Late\u00a0Sakal\u00a0Singh\u00a0and\u00a0Rampukar\u00a0Singh\u00a0S\/o\u00a0Late\u00a0Ramsurat\u00a0Singh.\n<\/p>\n<p>                    The \u00a0 petitioners \u00a0 were \u00a0 dismissed \u00a0 from \u00a0 the \u00a0 police \u00a0 department \u00a0 on \u00a0 24.01.1992\u00a0<br \/>\n          while \u00a0 they \u00a0 were \u00a0 discharging \u00a0 their \u00a0 duties \u00a0 as \u00a0 Assistant \u00a0 Sub\u00adInspector. \u00a0 The \u00a0 first\u00a0<br \/>\n          information\u00a0report\u00a0was\u00a0registered\u00a0against\u00a0them\u00a0under\u00a0Sections\u00a0148\/149\/302\u00a0of\u00a0the\u00a0<br \/>\n          Indian\u00a0Penal\u00a0Code\u00a0and\u00a0Section\u00a027\u00a0of\u00a0the\u00a0Arms\u00a0Act.\u00a0The\u00a0trial\u00a0commenced\u00a0and\u00a0in\u00a0the\u00a0<br \/>\n          sessions\u00a0trial,\u00a0the\u00a0accused\u00a0were\u00a0granted\u00a0a\u00a0clear\u00a0acquittal\u00a0holding\u00a0that\u00a0the\u00a0State\u00a0was\u00a0<br \/>\n          not\u00a0able\u00a0to\u00a0establish\u00a0and\u00a0substantiate\u00a0the\u00a0allegations\u00a0of\u00a0the\u00a0first\u00a0information\u00a0report.\u00a0<br \/>\n          The\u00a0concluding\u00a0paragraph\u00a0of\u00a0the\u00a0judgment\u00a0dated\u00a013.05.2004\u00a0passed\u00a0by\u00a07th\u00a0 Addl.\u00a0<br \/>\n          Sessions\u00a0Judge,\u00a0Gaya\u00a0in\u00a0S.T.\u00a0No.\u00a0117\/2003\u00a0and\u00a0269\/2003\u00a0held\u00a0that\u00a0the\u00a0husband\u00a0of\u00a0<br \/>\n          the\u00a0first\u00a0Informant\u00a0was,\u00a0no\u00a0doubt,\u00a0murdered\u00a0but\u00a0there\u00a0is\u00a0not\u00a0a\u00a0single\u00a0witness\u00a0who\u00a0<br \/>\n          has\u00a0 come \u00a0 forward \u00a0 to \u00a0 support \u00a0 the \u00a0 prosecution \u00a0 story \u00a0 and, \u00a0 therefore, \u00a0 the \u00a0 State \u00a0 has\u00a0<br \/>\n          miserably\u00a0failed\u00a0to\u00a0prove\u00a0its\u00a0case\u00a0against\u00a0the\u00a0accused\u00a0persons.\u00a0\n<\/p>\n<p>                     It\u00a0is\u00a0brought\u00a0to\u00a0my\u00a0notice\u00a0that\u00a0this\u00a0was\u00a0not\u00a0the \u00a0acquittal \u00a0on\u00a0the\u00a0basis\u00a0of\u00a0<br \/>\n          &#8216;benefit\u00a0of\u00a0doubt&#8217;\u00a0but\u00a0it\u00a0is\u00a0a\u00a0case\u00a0of\u00a0clear\u00a0acquittal\u00a0for\u00a0want\u00a0of\u00a0sufficient\u00a0evidence\u00a0and,\u00a0<br \/>\n          therefore,\u00a0the\u00a0petitioners\u00a0have\u00a0been\u00a0honourably\u00a0granted\u00a0verdict\u00a0of\u00a0acquittal\u00a0under\u00a0<br \/>\n          Sections\u00a0302\/149,\u00a0109\/149,\u00a0201\u00a0of\u00a0the\u00a0Indian\u00a0Penal\u00a0Code\u00a0and\u00a0also\u00a0under\u00a0Section\u00a027\u00a0<br \/>\n          of\u00a0the\u00a0Arms\u00a0Act.\u00a0Simultaneously,\u00a0the\u00a0departmental\u00a0proceeding\u00a0had\u00a0also\u00a0commenced.\u00a0<br \/>\n          The\u00a0set\u00a0of\u00a0evidence\u00a0was\u00a0identical\u00a0and\u00a0the\u00a0Enquiry\u00a0Officer\u00a0proceeded\u00a0with\u00a0the\u00a0regular\u00a0<br \/>\n          departmental\u00a0proceedings.\u00a0Subsequent\u00a0to\u00a0acquittal\u00a0in\u00a0the\u00a0criminal\u00a0trial,\u00a0the\u00a0Enquiry\u00a0<br \/>\n          Officer \u00a0 also \u00a0 exonerated \u00a0 the \u00a0 petitioners, \u00a0 along \u00a0 with \u00a0 other \u00a0 similarly \u00a0 placed \u00a0 police\u00a0<br \/>\n          officials,\u00a0as\u00a0the\u00a0evidence\u00a0led\u00a0in\u00a0the\u00a0criminal\u00a0case\u00a0as\u00a0well\u00a0as\u00a0in\u00a0the\u00a0domestic\u00a0enquiry\u00a0<br \/>\n          was\u00a0one \u00a0and\u00a0 same\u00a0and \u00a0since \u00a0the\u00a0 criminal \u00a0court\u00a0had \u00a0acquitted \u00a0the\u00a0delinquent\u00a0 on\u00a0<br \/>\n          those\u00a0very\u00a0evidence,\u00a0therefore,\u00a0several\u00a0other\u00a0employees\u00a0of\u00a0the\u00a0police\u00a0department,\u00a0<br \/>\n          namely,\u00a0Ram\u00a0Pravesh\u00a0Pandit\u00a0&amp;\u00a0Ors.\u00a0in\u00a0C.W.J.C.\u00a0No.\u00a06329\u00a0of\u00a01995\u00a0and\u00a0Satya\u00a0Narayan\u00a0<br \/>\n          Singh\u00a0&amp;\u00a0Ors.\u00a0in\u00a0C.W.J.C.\u00a0No.\u00a06330\u00a0of\u00a01995\u00a0\u00a0were\u00a0reinstated\u00a0setting\u00a0aside\u00a0the\u00a0order\u00a0of\u00a0<br \/>\n          the\u00a0Disciplinary\u00a0Authority.\u00a0It\u00a0was\u00a0confirmed\u00a0by\u00a0the\u00a0Division\u00a0Bench\u00a0by\u00a0a\u00a0judgment\u00a0<br \/>\n          dated\u00a029.08.2005.\u00a0The\u00a0said\u00a0decision\u00a0in\u00a0the\u00a0connected\u00a0two\u00a0writ\u00a0petitions\u00a0is\u00a0reported\u00a0<br \/>\n          in \u00a02005(4)\u00a0JLJR\u00a0164.\u00a0The\u00a0petitioners\u00a0were\u00a0directed\u00a0for\u00a0their\u00a0reinstatement\u00a0in\u00a0the\u00a0<br \/>\n          writ\u00a0petitions\u00a0on\u00a0the\u00a0basis\u00a0of\u00a0several\u00a0decisions\u00a0of\u00a0the\u00a0Apex\u00a0Court.\u00a0The\u00a0leading\u00a0case\u00a0is\u00a0<br \/>\n         Captain\u00a0M.\u00a0Paul\u00a0Anthony\u00a0Vs.\u00a0Bharat\u00a0Gold\u00a0Mines\u00a0Ltd.\u00a0 reported\u00a0in\u00a0(1999) \u00a03\u00a0SCC\u00a0769\u00a0<br \/>\n         followed\u00a0in\u00a0several\u00a0other\u00a0decisions\u00a0in\u00a0the\u00a0case\u00a0of \u00a0Krishna\u00a0Kali\u00a0Tea\u00a0Estate\u00a0Vs.\u00a0Akhil \u00a0<br \/>\n         Bhartiya\u00a0Chah\u00a0Mazdoor\u00a0Sangh\u00a0 reported\u00a0in\u00a0 \u00a0(2004) \u00a08\u00a0SCC\u00a0200\u00a0 and\u00a0also\u00a0the\u00a0case\u00a0of\u00a0<br \/>\n         Manager,\u00a0Reserve\u00a0Bank\u00a0of\u00a0India\u00a0Vs.\u00a0S.\u00a0Mani\u00a0reported\u00a0in\u00a0(2005)\u00a05\u00a0SCC\u00a0100.\n<\/p>\n<p>                    The\u00a0decision\u00a0in\u00a0the\u00a0case\u00a0of\u00a0Ram\u00a0Pravesh\u00a0Pandit\u00a0and\u00a0Satya\u00a0Narayan\u00a0Singh\u00a0was\u00a0<br \/>\n         also\u00a0challenged\u00a0in\u00a0L.P.A.\u00a0No.\u00a0656\u00a0of\u00a02005\u00a0and\u00a0L.P.A.\u00a0No.\u00a0657\u00a0of\u00a02005,\u00a0which\u00a0stands\u00a0<br \/>\n         dismissed \u00a0 by \u00a0 the \u00a0 Division \u00a0 Bench. \u00a0 The \u00a0 decision \u00a0 of \u00a0 the \u00a0 two \u00a0 L.P.A. \u00a0 has \u00a0 also \u00a0 been\u00a0<br \/>\n         brought\u00a0to\u00a0my\u00a0notice.\u00a0It\u00a0is\u00a0thus\u00a0evident\u00a0that\u00a0after\u00a0the\u00a0writ\u00a0petition\u00a0of\u00a0the\u00a0aforesaid\u00a0<br \/>\n         employees\u00a0was\u00a0allowed,\u00a0they\u00a0have\u00a0been\u00a0reinstated\u00a0in\u00a0service\u00a0and\u00a0they\u00a0are\u00a0working\u00a0<br \/>\n         though\u00a050%\u00a0of\u00a0the\u00a0salary\u00a0for\u00a0the\u00a0period\u00a0was\u00a0awarded\u00a0to\u00a0them.\u00a0\u00a0\n<\/p>\n<p>                    In\u00a0my\u00a0view,\u00a0the\u00a0petitioners\u00a0in\u00a0the\u00a0instant\u00a0writ\u00a0petition\u00a0are\u00a0also\u00a0entitled\u00a0for\u00a0<br \/>\n         the\u00a0same\u00a0benefit,\u00a0as\u00a0they\u00a0have\u00a0been\u00a0given\u00a0acquittal\u00a0in\u00a0the\u00a0criminal\u00a0case\u00a0as\u00a0well\u00a0as\u00a0the\u00a0<br \/>\n         Enquiry\u00a0Officer\u00a0has\u00a0exonerated\u00a0them.\u00a0No\u00a0doubt,\u00a0the\u00a0Disciplinary\u00a0Authority\u00a0disagreed\u00a0<br \/>\n         with\u00a0the\u00a0findings\u00a0of\u00a0the\u00a0Enquiry\u00a0Officer\u00a0and\u00a0dismissed\u00a0the\u00a0petitioners\u00a0and\u00a0they\u00a0are\u00a0<br \/>\n         out \u00a0 of \u00a0 service \u00a0 since \u00a0 a \u00a0 long \u00a0 time. \u00a0 The \u00a0 petitioners \u00a0 are \u00a0 also \u00a0 entitled \u00a0 for \u00a0 a \u00a0 similar\u00a0<br \/>\n         treatment,\u00a0as\u00a0in\u00a0the\u00a0case\u00a0of\u00a0other\u00a0police\u00a0officials\u00a0who\u00a0were\u00a0granted\u00a0acquittal,\u00a0along\u00a0<br \/>\n         with\u00a0the\u00a0present\u00a0petitioners\u00a0in\u00a0\u00a0\u00a0S.T.\u00a0No.\u00a0117\/2003\u00a0and\u00a0269\/2003.\n<\/p>\n<p>                    In\u00a0the\u00a0facts\u00a0and\u00a0circumstances,\u00a0the\u00a0writ\u00a0petition\u00a0is\u00a0allowed.\u00a0The\u00a0petitioners\u00a0<br \/>\n         are\u00a0directed\u00a0to\u00a0be\u00a0reinstated\u00a0in\u00a0service\u00a0with\u00a0only\u00a050%\u00a0of\u00a0the\u00a0salary\u00a0for\u00a0the\u00a0period.\u00a0<br \/>\n         The\u00a0dismissal\u00a0order\u00a0dated\u00a024.01.1992\u00a0(Annexure\u00ad3)\u00a0as\u00a0well\u00a0as\u00a0the\u00a0appellate\u00a0order\u00a0<br \/>\n         dated \u00a0 21.08.1994 \u00a0 (Annexure\u00ad4) \u00a0 and \u00a0 also \u00a0 the \u00a0 revisional \u00a0 order \u00a0 dated \u00a0 22.03.2005\u00a0<br \/>\n         (Annexure\u00ad7)\u00a0are\u00a0hereby\u00a0quashed.\u00a0\n<\/p>\n<p>                    With\u00a0the\u00a0aforesaid\u00a0observations\u00a0and\u00a0directions,\u00a0this\u00a0writ\u00a0petition\u00a0is\u00a0disposed\u00a0<br \/>\n         of.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\n<\/p>\n<p>                  \u00a0\u00a0      \u00a0\u00a0                                          \u00a0
