Justice V.GIRI\n\n Dated :03\/06\/2009\n\n O R D E R\n                      V.GIRI, J.\n             ---------------------------\n              W.P.(C).15206, 15238, 15284,\n                  15304 &amp; 15313 of 2009\n             ---------------------------\n         Dated this the 3rd day of June, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>           The vehicles belonging to petitioners in all<\/p>\n<p>these cases were allegedly seized for infraction of the<\/p>\n<p>provisions of the Kerala Protection of River Banks<\/p>\n<p>(Protection and Regulation of removal of sand) Act,<\/p>\n<p>2002. They have approached the District Collector, the<\/p>\n<p>1st respondent for release of the vehicles and are<\/p>\n<p>aggrieved by the non-consideration of their request as<\/p>\n<p>such.\n<\/p>\n<p>           2. The nature of the power exercised by the<\/p>\n<p>District Collector and the para meters within which such<\/p>\n<p>power is to be exercised have been dealt with by a Bench<\/p>\n<p>of this Court in Sanjayan Vs.Tahasildar [2007 (4) KLT<\/p>\n<p>597]. Principles have been reiterated in Subramanian<\/p>\n<p>Vs. State of Kerala [2009 (1) KLT 77).<\/p>\n<p>           3.    In   Subramanian&#8217;s   case,  this  Court<\/p>\n<p>observed that      the power exercised by the District<\/p>\n<p>W.P.(C).15206 of 2009 &amp; Con.cases<\/p>\n<p>                         :: 2 ::\n<\/p>\n<p>Collector is under Section 23 of the Kerala Protection of<\/p>\n<p>River Banks (Protection and Regulation of removal of<\/p>\n<p>sand) Act, 2002. It is also, therefore, quasi judicial in<\/p>\n<p>character. Reasons will have to be given by the District<\/p>\n<p>Collector while passing orders under Section 23 of the<\/p>\n<p>Kerala Protection of River Banks (Protection and<\/p>\n<p>Regulation of removal of sand) Act, 2002 r\/w Rules 27<\/p>\n<p>and 28 of Kerala Protection of         River Banks and<\/p>\n<p>Regulation of Removal of Sand Rules 2002. If there is a<\/p>\n<p>contention that      the transportation of sand was<\/p>\n<p>supported by a pass issued       by the competent local<\/p>\n<p>authority, that has to be referred. The materials which<\/p>\n<p>are placed before      the District Collector    by the<\/p>\n<p>subordinate officials shall also be looked into. This has<\/p>\n<p>been   indicated in Subramanian&#8217;s case.      If motion is<\/p>\n<p>made by the owners of the vehicles for release of the<\/p>\n<p>vehicles on interim custody, it will be subject to the<\/p>\n<p>conditions mentioned in paragraph 58 of the said<\/p>\n<p>judgment.    The District Collector may pass orders on<\/p>\n<p>W.P.(C).15206 of 2009 &amp; Con.cases<\/p>\n<p>                           :: 3 ::\n<\/p>\n<p>such applications for interim custody. (The scope of the<\/p>\n<p>directions contained in Subramanian&#8217;s case have later<\/p>\n<p>been dealt with in WPC No.14319\/2009.         Appropriate<\/p>\n<p>clarifications have been issued in the latter judgment).<\/p>\n<p>Further conditions can be imposed in the course of<\/p>\n<p>release of the vehicles as indicated by this Court in<\/p>\n<p>Shoukathali Vs. Tahasildar [2009 (1) KLT 640].<\/p>\n<p>            4.   Keeping in mind the         observations<\/p>\n<p>made in      the judgments in Shoukathali&#8217;s case and<\/p>\n<p>Subramanian&#8217;s case and       other judgment which have<\/p>\n<p>been referred to, the 1st respondent in these cases shall<\/p>\n<p>pass final orders in the matter of confiscation\/release of<\/p>\n<p>the vehicles in question after conducting an appropriate<\/p>\n<p>enquiry as early as possible, at any rate within three<\/p>\n<p>months from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p>            5.   In the meanwhile, if motion is made by<\/p>\n<p>the petitioners for interim custody of the vehicles, then<\/p>\n<p>orders shall be passed by the District Collector on the<\/p>\n<p>W.P.(C).15206 of 2009 &amp; Con.cases<\/p>\n<p>                          :: 4 ::\n<\/p>\n<p>applications for interim custody of the vehicles, within<\/p>\n<p>three weeks from the date of receipt of a copy of this<\/p>\n<p>judgment in the light of the observations contained in<\/p>\n<p>Shoukathali   Vs.   Tahasildar   [2009   (1) KLT   640],<\/p>\n<p>Subramanian Vs.
