KRISHNAN, J\n                        -----------------------\n                     M.F.A.No. 172 OF 2008\n                   ---------------------------------\n             Dated this the 13th day of November, 2008\n\n\n                             JUDGMENT\n<\/pre>\n<p>      This appeal is preferred against the award of the Workmen&#8217;s<\/p>\n<p>Compensation Commissioner, Trichur in W.C.C No. 400\/2002. The<\/p>\n<p>Claimant while employed as a driver of an Autorickshaw sustained<\/p>\n<p>injuries in a road accident.        He moved an application for<\/p>\n<p>compensation under the Workmen Compensation Act.                  The<\/p>\n<p>Workmen Commissioner fixed his income at Rs. 3,300\/-, disability<\/p>\n<p>at 12% and applying an appropriate index and arrive at a<\/p>\n<p>compensation of Rs. 53,222\/- with a direction to pay interest from<\/p>\n<p>the date of accident.    It is against that decision the Insurance<\/p>\n<p>Company has come up in appeal.\n<\/p>\n<p>      2. The accident had taken place in the year 2002 and the<\/p>\n<p>Workmen Compensation fixed the amount at Rs. 3,300\/- as income<\/p>\n<p>for an auto driver.       Especially taking into consideration the<\/p>\n<p>prevailing circumstances one can find that it is not on the higher<\/p>\n<p>side and it is a question of fact which is decided after consideration<\/p>\n<p>of the materials.\n<\/p>\n<p>      3. The next question is regarding disability. A document has<\/p>\n<p>M.F.A.No. 172 OF 2008<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>been produced whereby permanent disability is shown as 9% and<\/p>\n<p>loss of earning capacity at 15%. Commissioner has only taken 12%<\/p>\n<p>loss of earning capacity and had calculated the compensation.<\/p>\n<p>Under the provisions of the Workmen Compensation Act, the proper<\/p>\n<p>authority to fix loss of earning capacity is a medical expert. In spite<\/p>\n<p>of the same, the Compensation Commissioner has reduced<\/p>\n<p>percentage and therefore it cannot be also said to be on the higher<\/p>\n<p>side.\n<\/p>\n<p>      4.   Lastly the question is regarding interest.     The learned<\/p>\n<p>counsel for the appellant relies upon a later decision of the Supreme<\/p>\n<p>Court reported in <a href=\"\/doc\/87422\/\">National Insurance Co. Ltd. vs. Mubasir<\/p>\n<p>Ahmed and<\/a> another (2007 AIR SCW 1265) It is laid down in<\/p>\n<p>that decision that one can get interest only from the date of the<\/p>\n<p>award. A Division Bench of this Court in the decision reported in<\/p>\n<p><a href=\"\/doc\/636231\/\">National Insurance Co. Ltd. v. Rekha<\/a> [2007 (4) KLT 386] had<\/p>\n<p>considered this question.     The Division Bench had referred to a<\/p>\n<p>larger Bench decision of the Apex Court which is reported in Pratap<\/p>\n<p>Narain Singh Deo v. Shrinivas Sababa &amp; another [AIR 1976<\/p>\n<p>SC 222] and further held that when there is a conflict between<\/p>\n<p>decision of Supreme Court, the decision of larger Bench will prevail.<\/p>\n<p>M.F.A.No. 172 OF 2008<br \/>\n<span class=\"hidden_text\">                                 -3-<\/span><\/p>\n<p>According to the decision of the larger Bench, the entitlement of<\/p>\n<p>interest is from the date of accident and not later. Therefore on<\/p>\n<p>that point also the matter is specifically covered by the decision<\/p>\n<p>referred to above.   From this discussion I hold that there is no<\/p>\n<p>substantial question of law much less any question of law involved<\/p>\n<p>in this appeal.\n<\/p>\n<p>      Therefore the appeal lacks merit and dismissed.<\/p>\n<p>                                     M.N.
