Gujarat  Electricity  Board. As per the say of<br \/>\nthe petitioner, the father of the petitioner had sold his flour mill<br \/>\nto the respondent No.3 herein and it is the respondent No.3 who has<br \/>\nutilized the electricity connection for running such flour mill. When<br \/>\nthe Electricity Company has raised the bill for outstanding unpaid<br \/>\ndues for consumption of electricity amounting to Rs.8557\/-, the<br \/>\npetitioner contended that it was the respondent No.3 who had consumed<br \/>\nthe electricity and therefore, he was liable to pay the electricity<br \/>\ncharges. The stand of the Electricity Company as emerging from its<br \/>\ncommunication dated 26.08.1996 which is produced at Annexure-F to the<br \/>\npetition that Bhogilal Chhotalal was the person who was granted<br \/>\nelectricity connection but since he expired, the petitioner being<br \/>\nheir of the deceased, it was the duty of the petitioner to pay the<br \/>\nbill. The transaction of the sale of the flour mill between the<br \/>\nfather of the petitioner and the respondent No.3 was an internal<br \/>\naffair.\n<\/p>\n<p>\tIt<br \/>\nis undisputed that the electricity connection was running in the name<br \/>\nof   Bhogilal Chhotalal i.e. father of the petitioner. Even if the<br \/>\nsaid  Bhogilal Chhotalal had sold his flour mill to the respondent<br \/>\nNo.3, he never requested the electricity company to transfer the<br \/>\nelectrical connection in the name of the respondent No.3 or<br \/>\ndisconnect the same. Electricity consumption charges was required to<br \/>\nbe paid by the consumer in whose name the electrical connection was<br \/>\ngranted and the petitioner as heir was liable to pay the same. If the<br \/>\nfather of the petitioner and after his death, the petitioner had<br \/>\nceased to be consumer, it was their duty to have electrical<br \/>\nconnection discontinued.\n<\/p>\n<p>\tUnder<br \/>\nthe circumstances, I find no illegality in the impugned<br \/>\ncommunication. The petition is, therefore, dismissed.\n<\/p>\n<p>\tRule<br \/>\nis discharged.
