Justice M.SASIDHARAN NAMBIAR\n\n Dated :31\/03\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.1116 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner   is   the   accused   and    second<\/p>\n<p>respondent,  the  defacto  complainant  in  C.C.No.<\/p>\n<p>572\/2007  on  the  file  of  Judicial  First  Class<\/p>\n<p>Magistrate&#8217;s Court-IV, Kozhikode, taken cognizance<\/p>\n<p>for the offences under Sections 468, 471 and 420 of<\/p>\n<p>Indian Penal Code on Annexure-A1 final report.<\/p>\n<p>Prosecution case is that after 31.10.2005, inducing<\/p>\n<p>the  second  respondent  to  believe  that  a   JCB<\/p>\n<p>belonging to Gaylord Earth Movers, due to the loss<\/p>\n<p>in the business the shop has been closed and the<\/p>\n<p>JCB was entrusted to the petitioner for sale, made<\/p>\n<p>the second respondent to purchase the same and<\/p>\n<p>thereby committed the offences. This petition is<\/p>\n<p>filed  under  Section  482  of  Code  of   Criminal<\/p>\n<p>Procedure to quash the cognizance taken and the<\/p>\n<p>case pending before the Magistrate contending that<\/p>\n<p>the offences alleged against the petitioner are<\/p>\n<p><span class=\"hidden_text\">CRMC 1116\/10              2<\/span><\/p>\n<p>purely    personal  in  nature against the   second<\/p>\n<p>respondent    and  all the  disputes were  amicably<\/p>\n<p>settled between the parties and consequent to the<\/p>\n<p>settlement, it is not in the interest of justice to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p>    2. Second respondent appeared through a counsel<\/p>\n<p>and filed an affidavit stating that entire disputes<\/p>\n<p>were settled amicably and therefore, he has no<\/p>\n<p>objection for quashing the proceedings.<\/p>\n<p>    3.      Learned  counsel  appearing  for    the<\/p>\n<p>petitioner, second respondent and learned Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>    4. The offences alleged against the petitioner<\/p>\n<p>are purely personal in nature as is clear from<\/p>\n<p>Annexure-A1 final report. Affidavit filed by the<\/p>\n<p>second respondent establishes that entire disputes<\/p>\n<p>with the petitioner were amicably settled. As held<\/p>\n<p>by the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of<\/p>\n<p>Punjab<\/a> (2008 (3) KLT 19) and Manoj Sharma v. State<\/p>\n<p>(2008 (4) KLT 417), when all the disputes were<\/p>\n<p><span class=\"hidden_text\">CRMC 1116\/10             3<\/span><\/p>\n<p>amicably settled between the parties, it is not in<\/p>\n<p>the    interest  of   justice  to    continue   the<\/p>\n<p>prosecution.\n<\/p>\n<p>     Petition is allowed.
