SHAH\n\t\t\n\t\n\n \n\nDate\n: 17\/10\/2011 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>[1.0]\t\tPresent<br \/>\napplication under Section 482 of the Code of Criminal Procedure, 1973<br \/>\n(hereinafter referred to as &#8220;CrPC&#8221;) has been preferred by<br \/>\nthe applicants &#8211; original accused to quash and set aside the<br \/>\nimpugned Criminal Case No.63\/2009 pending in the Court of learned<br \/>\nChief Judicial Magistrate, Daman.\n<\/p>\n<p>[2.0]\t\tAt<br \/>\nthe outset, Shri Majmudar, learned advocate appearing on behalf of<br \/>\nthe applicants seeks permission to withdraw the present application.<br \/>\nEven otherwise, the present application to quash and set aside the<br \/>\nCriminal Case pending in the Court of learned Chief Judicial<br \/>\nMagistrate, Daman would not be maintainable before this High Court.\n<\/p>\n<p>[4.0]\t\tIn<br \/>\nany case, considering the request made by Shri Majmudar, learned<br \/>\nadvocate appearing on behalf of the applicants, present application<br \/>\nis dismissed as withdrawn.
