Justice C.T.RAVIKUMAR\n\n Dated :21\/07\/2010\n\n O R D E R\n                         C.T.RAVIKUMAR, J.\n                       ----------------------------\n                       W.P.(C)No.20128 of 2010\n                       ----------------------------\n                         Dated 21st July, 2010\n\n                              JUDGMENT\n<\/pre>\n<p>             The petitioner is aggrieved by the inaction on the part of<\/p>\n<p>the second respondent in passing orders in the matter of approval of<\/p>\n<p>his appointment as H.S.A. (English) under the third respondent&#8217;s<\/p>\n<p>school.    According to the petitioner, as per Ext.P1 order she was<\/p>\n<p>promoted as H.S.A. (English) on 15.7.2004 against a regular<\/p>\n<p>vacancy. The said appointment was not approved and consequently<\/p>\n<p>she was reverted as U.P.S.A.       Later, as per Ext.P5, the petitioner<\/p>\n<p>was again promoted as H.S.A. (English) with effect from 1.6.2009.<\/p>\n<p>The said order of promotion was forwarded to the second<\/p>\n<p>respondent. However, no orders have been passed thereon so far.<\/p>\n<p>It is in the said circumstances that this writ petition has been filed.<\/p>\n<p>             2. When appointment or promotion has been effected as<\/p>\n<p>per the provisions under the Kerala Education Rules, the same has to<\/p>\n<p>be forwarded to the competent educational authority for approval.<\/p>\n<p>Evidently, in this case, Ext.P5 order whereby the petitioner was<\/p>\n<p>promoted as H.S.A. (English) with effect from 1.6.2009 has already<\/p>\n<p>been forwarded to the second respondent for such approval. The<\/p>\n<p>second respondent is legally bound to pass orders in the matter.
