Justice C.K.ABDUL REHIM\n\n Dated :12\/05\/2009\n\n O R D E R\n                  V.GIRI &amp; C.K.ABDUL REHIM, JJ.\n                   =========================\n                       W.A.No.1014 of 2009\n                  ===============================\n                Dated this the 12th day of May, 2009.\n\n                          J U D G M E N T\n<\/pre>\n<p>Giri, J.\n<\/p>\n<p>      The  appellant\/writ   petitioner    challenges the   revenue<\/p>\n<p>recovery proceedings initiated by the respondents for recovery of<\/p>\n<p>amounts due from him to the GCDA. Learned Single Judge took<\/p>\n<p>note of the fact that a civil suit filed by the appellant had been<\/p>\n<p>dismissed, that the learned standing counsel for the GCDA<\/p>\n<p>contended that an amount of Rs.2,35,000\/- is still outstanding<\/p>\n<p>and that the transaction is more than twenty four years old.<\/p>\n<p>      2.  Referring    to    the    submission     made   by   the<\/p>\n<p>appellant\/petitioner that he intends to file an appeal against the<\/p>\n<p>decree, recovery proceedings were kept in abeyance subject to<\/p>\n<p>the condition that the appellant\/petitioner pays an amount of<\/p>\n<p>Rs.75,000\/- within one month from the date of the judgment.<\/p>\n<p>That judgment is challenged in this writ appeal.<\/p>\n<p>      3.  We heard the learned counsel for the appellant and the<\/p>\n<p>learned standing counsel for the GCDA.<\/p>\n<p>W.A.No.1014 of 2009<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p>      4.   The condition imposed by the learned Single Judge<\/p>\n<p>cannot be considered as unreasonable and does not warrant any<\/p>\n<p>interference by this Court.
