Justice M.SASIDHARAN NAMBIAR\n\n Dated :06\/10\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          CRL.M.C.No. 3790   OF 2010\n          ===========================\n\n    Dated this the 6th day of October,2010\n\n                     ORDER\n<\/pre>\n<p>    Crime  129\/2010  of   Kunnamangalam  Police<\/p>\n<p>Station was registered for the offences under<\/p>\n<p>section 392 read with section 34 of Indian<\/p>\n<p>Penal code on the first information furnished<\/p>\n<p>by Sruthinlal. Case in the First Information<\/p>\n<p>Statement is that petitioner the brother of his<\/p>\n<p>father,   is a goldsmith who prepares gold<\/p>\n<p>ornaments. After completing the work of making<\/p>\n<p>gold ornaments, petitioner used to send them<\/p>\n<p>to jewellry Malabar Gold at Ernakulam Jose<\/p>\n<p>junction  through  the   first  informant.   On<\/p>\n<p>12.4.2010 at about 4.30 a.m, when Sruthinlal<\/p>\n<p>was proceeding to Malabar Gold carrying     the<\/p>\n<p>gold ornaments in a bag, in his scooter, three<\/p>\n<p>persons wrongfully restrained him thereafter<\/p>\n<p>robbed the bag containing 1.3 kgms of gold<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.3790\/2010            2<\/span><\/p>\n<p>ornaments.        When a portion of the gold ornaments<\/p>\n<p>were seized and produced before Judicial First<\/p>\n<p>Class Magistrate&#8217;s Court, Kunnamangalam, petitioner<\/p>\n<p>filed Annexure B petition under section 451 of Code<\/p>\n<p>of Criminal Procedure for interim custody of the<\/p>\n<p>vehicle submitting that he is prepared to furnish<\/p>\n<p>any     security.      By  Annexure  C  order,  learned<\/p>\n<p>Magistrate dismissed the petition.        This petition<\/p>\n<p>is filed under section 482 of Code of Criminal<\/p>\n<p>Procedure to quash Annexure C order and to grant<\/p>\n<p>interim custody of the gold ornaments to            the<\/p>\n<p>petitioners.\n<\/p>\n<p>      2.         Learned counsel   appearing  for   the<\/p>\n<p>petitioner       and  learned  Public  Prosecutor  were<\/p>\n<p>heard.\n<\/p>\n<p>      3.      Learned Public Prosecutor submitted that<\/p>\n<p>subsequently some more gold ornaments were seized<\/p>\n<p>and produced before the learned Magistrate and<\/p>\n<p>after completing the investigation final report has<\/p>\n<p>also been submitted, though offences were           not<\/p>\n<p>taken cognizance.\n<\/p>\n<p>      4. Prosecution case itself is that the gold<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.3790\/2010             3<\/span><\/p>\n<p>ornaments        seized  were  entrusted  to the   first<\/p>\n<p>informant by the petitioner, to be entrusted to the<\/p>\n<p>Jeweller and on the way it was robbed by the<\/p>\n<p>accused.         In such circumstances, petitioner is<\/p>\n<p>entitled to get interim custody of gold ornaments<\/p>\n<p>on     conditions.         Unfortunately   the   learned<\/p>\n<p>Magistrate dismissed          the petition filed under<\/p>\n<p>section 451 of Code of Criminal Procedure without<\/p>\n<p>taking       note of the decision of the Apex court in<\/p>\n<p><a href=\"\/doc\/1224953\/\">Jamal Uddin Ahmad v. Abu Saleh Najmuddin<\/a> (2003(2)<\/p>\n<p>KLT 638). Petitioner has also submitted that he is<\/p>\n<p>prepared        to   furnish  any   security.  In   such<\/p>\n<p>circumstances,        Annexure  C  order  can  only   be<\/p>\n<p>quashed.\n<\/p>\n<p>      Petition is allowed.         Annexure C order is<\/p>\n<p>quashed.
