Amendment granted. Heard Mr. Hasurkar <FONT SIZE=\"3\">for the<br \/>\npetitioner &amp; Mr. Mehta for the respondents. The petitioner is a<br \/>\nson of the deceased employee of the respondents. The respondent<br \/>\nCommission is having a scheme dt. 09.04.92 whereunder in the event of<br \/>\ndeath of an employee, in lieu of gainful employment, to one of the<br \/>\ndependents, the Commission Pays some lump sum amount to the family<br \/>\nmembers to tide over the difficulty. Initially an amount of Rs.<br \/>\n45,000\/- was offered which offer was subsequently enhanced to Rs.<br \/>\n85,000\/-, as per the provisions under the scheme applicable to the<br \/>\ndeceased employees. For reasons best known to the petitioner and his<br \/>\nmother they refused to take that amount. Firstly no dependents of a<br \/>\ndeceased employee on have Companssionate appointment as a matter of<br \/>\nright, but the dependent has to be considered for such a job. When a<br \/>\nminimum amount is offered in lieu of such employment to tide over the<br \/>\ndifficulty and if the dependents refuse to take that amount, there is<br \/>\nnothing further that the Commission should do.<\/FONT><\/FONT><\/FONT><\/FONT><\/P><br \/>\n<P ALIGN=\"JUSTIFY\"><BR><BR><br \/>\n<\/P><br \/>\n<P ALIGN=\"JUSTIFY\"><FONT COLOR=\"#000000\"><FONT FACE=\"courier\"><FONT SIZE=\"3\">Three<br \/>\ngrounds are raised by Mr. Hasurkar. Firstly that there is a<br \/>\nclassification in making these payments depending upon the status of<br \/>\n the deceased employee. Secondly same others are given job in spite of<br \/>\nmaking such employment and thirdly no reasons are given while<br \/>\nrejecting the application of the petitioner. In my view all these<br \/>\ngrounds are untenable.
