Siri Jagan, J.\n                =-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=-=\n                          W.P(C) No. 267 of 2007\n                =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                 Dated this, the 2nd day of June, 2010.\n\n                               J U D G M E N T\n<\/pre>\n<p>      The petitioner claims to be a freedom fighter. He applied for<\/p>\n<p>pension under the Swanthrata Sainik Samman Pension Scheme. That<\/p>\n<p>has been rejected by Ext. P3 order. The petitioner challenges Ext. P3<\/p>\n<p>order seeking the following reliefs:\n<\/p>\n<\/p>\n<blockquote><p>      &#8220;(i)   Issue a writ of mandamus, or such other writ, order or<br \/>\n      direction directing respondents to reconsider the application<br \/>\n      submitted by the petitioner in the year 1982, and grant the<br \/>\n      pensional benefits of freedom fights to the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>      (ii)   Issue a writ of certiorari, or such other writ, order or<br \/>\n      direction to quash Ext. P3 order.\n<\/p><\/blockquote>\n<blockquote><p>      (iii)  Declare that the petitioner is a freedom fighter.\n<\/p><\/blockquote>\n<blockquote><p>      (iv)   Declare that the petitioner is entitled to all rights, privileges,<br \/>\n      pension benefits and other benefits due to a freedom fighter.&#8221;<\/p><\/blockquote>\n<p>      2.   Under the SSS Pension Scheme, to enable the Central<\/p>\n<p>Government to consider the claim of the petitioner, the State<\/p>\n<p>Government has to consider the claim and recommend the same.<\/p>\n<p>Respondents 2 and 3 would contend that the State Government has<\/p>\n<p>not recommended the petitioner&#8217;s claim. The 1st respondent has filed<\/p>\n<p>a counter affidavit stating that the petitioner has not produced the<\/p>\n<p>relevant certificates proving his jail sufferings             viz.   co-prisoner&#8217;s<\/p>\n<p>certificates in the prescribed form with a non-availability of records<\/p>\n<p>certificate.     Instead, he has produced Ext. P1 letter from one D.<\/p>\n<p>Damodaran Potti in his letter pad stating that the petitioner is a<\/p>\n<p>freedom fighter. Therefore, according to the State Government, the<\/p>\n<p>petitioner has not proved his jail sufferings in accordance with the<\/p>\n<p>scheme for becoming eligible for freedom fighters pension.<\/p>\n<p>      3. I have considered the rival contentions in detail.<\/p>\n<p>      4. Even along with this writ petition, the petitioner has not<\/p>\n<p><span class=\"hidden_text\">W.P.C. No. 267\/2007               -: 2 :-<\/span><\/p>\n<p>produced the relevant documents, which would enable him to claim<\/p>\n<p>pension. As per the scheme applicable, the petitioner has to prove his<\/p>\n<p>sufferings through co-prisoners who have more than one year&#8217;s jail<\/p>\n<p>suffering. The petitioner has not been able to produce even one. That<\/p>\n<p>being so, I do not think that the respondent could consider the<\/p>\n<p>petitioner&#8217;s claim favourably.\n<\/p>\n<p>      Accordingly, this writ petition is dismissed.<\/p>\n<p>                                           Sd\/- S.
