No.21231 of 2011\n                                            Raju Sah\n                                             Versus\n                                      The State Of Bihar\n                                           -----------\n<\/pre>\n<p>02\/   25.07.2011           Supplementary affidavit is filed on behalf of the<\/p>\n<p>                   petitioner.\n<\/p>\n<p>                                 Heard learned counsel for the petitioner as well as<\/p>\n<p>                   learned Addl. Public Prosecutor for the State.<\/p>\n<p>                                 There is specific allegation against the petitioner that he<\/p>\n<p>                   along with two co-accused persons, namely, Sunil Sah and Bhushi<\/p>\n<p>                   Sah mercilessly assaulted the deceased with iron rod as a result of<\/p>\n<p>                   which deceased sustained injury and died in course of his treatment.<\/p>\n<p>                                 Learned counsel for the petitioner drew my attention<\/p>\n<p>                   towards annexure 4 of supplementary affidavit and submitted that<\/p>\n<p>                   only one head injury has been found on the person of the deceased<\/p>\n<p>                   and furthermore, alleged occurrence did not take place in a<\/p>\n<p>                   preplanned manner rather sudden altercation took place between the<\/p>\n<p>                   parties as a result of which alleged occurrence took place as per<\/p>\n<p>                   prosecution case itself. It is also contended by him that after death<\/p>\n<p>                   of the deceased when fardbeyan of the son of deceased was<\/p>\n<p>                   recorded he stated that several persons assaulted his father with<\/p>\n<p>                   lathi and iron rod.\n<\/p>\n<p>                                 Taking into consideration the above stated facts and<\/p>\n<p>                   circumstances as well as submissions of the parties, particularly,<\/p>\n<p>                   this aspect of the matter that deceased sustained only one head<\/p>\n<p>                   injury, let the petitioner, Raju Sah, be released on bail on furnishing<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>         bail bonds of Rs 10,000\/- with two sureties of the like amount each<\/p>\n<p>         to the satisfaction of the Addl. Sessions Judge IV, Chapra in<\/p>\n<p>         Sessions Trial no. 369\/2011 arising out of Taraiya P.S.
