As could be seen rrrrrr rirr-.rrrarrrir;+rr,\u00a2rr dated 4.3.2903 the<\/p>\n<p>learned csrrl Judge&#8217;i2&#8217;&amp;e\u00abr.ei3sereea.1;herein that the defendant remained<\/p>\n<p>absent despite &#8216;s:e\ufb01viee   \ufb02ierefore, the plaintiff was to<\/p>\n<p>file an   XV!!! Rule 4 of CPC and also pay the<\/p>\n<p>iiciu:ty;:i13:siV  the unregistered agreement by next date of<\/p>\n<p>  herrsrrg&#8221; ;re_,i1tr}:&gt;2(ir:&gt;3. Even ifit is assumed that as observed by the<\/p>\n<p>  .leatned r:rrrr.rrrgr in the order sheet dated 4.3.2003, are plaintiff<\/p>\n<p> &#8220;make the payment of duty and penalty on the unregistered<\/p>\n<p>it   and themfore, the learned Civil Judge passed the<\/p>\n<p>  -iiiipugned order U\/O V11 Rule i1( c ) cf CPC, \ufb01ne impugned order<\/p>\n<p>i cannot be sustained in law inasmuch as the question of payment of<\/p>\n<p>(We<\/p>\n<p>duty and penalty on the unregistered agreement on  the<\/p>\n<p>plain\ufb01ff relied upon would have arisen when the plaintiff _<\/p>\n<p>get the said document admitted in evidenee but fat V. <\/p>\n<p>earlier thereto. Therefore the impugneci:&#8217;\u00bb.:erd!er.. ::in<\/p>\n<p>total disregard to the relevant provieieias. of   en_ci4~es,.snch% it: L&#8217;<\/p>\n<p>cannot be sustained in law.  .\n<\/p>\n<p>4.
