Justice R.BASANT\n\n Dated :07\/02\/2008\n\n O R D E R\n                                  R.BASANT, J\n\n                           ------------------------------------\n\n                             B.A.No.709 of 2008\n\n                           -------------------------------------\n\n                Dated this the 7th day of February, 2008\n\n\n\n                                       ORDER\n<\/pre>\n<p>      Application  for  anticipatory bail.    Petitioners  are accused  2<\/p>\n<p>and 3.  Altogether there are 4 accused persons.  The crux of the<\/p>\n<p>allegations  is  that   the  petitioners, who  are   employees  of   a  new<\/p>\n<p>generation   bank,   had   forcibly   dispossessed   the   defacto<\/p>\n<p>complainant   of   a   vehicle   in   respect   of   which   a   financial<\/p>\n<p>arrangement   has   been   availed   from   the   said   bank.     Crime   has<\/p>\n<p>been   registered.     Investigation   is   in   progress.     The   petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<\/p>\n<p>      2.     The  learned   counsel   for   the   petitioners   submits   that<\/p>\n<p>the petitioners had not committed any offence and that they are<\/p>\n<p>willing   to   co-operate   with   the   investigator.     They   are   willing   to<\/p>\n<p>produce the vehicle before the investigator as and when directed<\/p>\n<p>by this Court, submits the learned counsel for the petitioners.<\/p>\n<p>      3.     The  learned   Public   Prosecutor    does   not   oppose   the<\/p>\n<p>application, but only submits that appropriate conditions may be<\/p>\n<p>imposed   in   the   interests   of   a   fair,   efficient   and   expeditious<\/p>\n<p>investigation.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.709 of 2008                        2<\/span><\/p>\n<p>       4.     I am satisfied that anticipatory bail can be granted to<\/p>\n<p>the petitioners.   In the absence of opposition, it is not necessary<\/p>\n<p>for   me   to   advert   to   facts   in   any   greater   detail   in   this   order.<\/p>\n<p>Appropriate conditions can of course be imposed in the interests<\/p>\n<p>of a proper investigation.\n<\/p>\n<\/p>\n<p>       5.     In   the   result,   the   Bail   Application   is,   allowed.     The<\/p>\n<p>following directions are issued under Section 438 Cr.P.C.<\/p>\n<p>       a)     The   petitioners   shall   produce   the   vehicle   before   the<\/p>\n<p>Investigating Officer on or before 14.02.08;<\/p>\n<p>       b)     The   petitioners   shall   appear   before   the   learned<\/p>\n<p>Magistrate   at   11   a.m   on   15.02.08.     They   shall   be   enlarged   on<\/p>\n<p>regular bail on condition that<\/p>\n<p>       i)     The   petitioners   satisfy   the  learned   Magistrate  that<\/p>\n<p>condition (a) above has been satisfied;\n<\/p>\n<\/p>\n<p>       ii)    They   execute   bonds   for   Rs.50,000\/-   (Rupees   Fifty<\/p>\n<p>thousand only)   each with two solvent sureties each for the like<\/p>\n<p>sum to the satisfaction of the learned Magistrate;<\/p>\n<p>       c)     The   petitioners   shall   make   themselves   available   for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p><span class=\"hidden_text\">B.A.No.709 of 2008                       3<\/span><\/p>\n<p>3   p.m   on   16.02.08   and   17.02.08   and   thereafter   as   and   when<\/p>\n<p>directed by the Investigating Officer in writing to do so;<\/p>\n<p>         d)    If   the   petitioners   do   not   appear   before   the   learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter   stand   revoked   and   the   police   shall   be   at   liberty   to<\/p>\n<p>arrest the petitioners and deal with them  in accordance with law<\/p>\n<p>as if those directions were not issued at all;<\/p>\n<p>         e)    If the petitioners were arrested prior to their surrender<\/p>\n<p>on   15.02.08   as   directed   in   clause   (1)   above,   they   shall   be<\/p>\n<p>released from custody on their executing a bond for Rs.50,000\/-<\/p>\n<p>(Rupees   Fifty   thousand   only)   each   without   any   sureties<\/p>\n<p>undertaking to appear before the learned Magistrate on 15.02.08.<\/p>\n<p>                                                       (R.BASANT, JUDGE)<\/p>\n<p>rtr\/-\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Santhosh Kumar vs State Of Kerala on 7 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 709 of 2008() 1.
