PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\nDate\n: 25\/01\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p>Learned APP, waives service of notice of rule on behalf of the<br \/>\nrespondent-State.\n<\/p>\n<p>1.\t\tThe<br \/>\npetitioner, by way of this petition, seeks anticipatory bail in<br \/>\nconnection with the complaint, bearing C.R. No. I-39\/10, filed before<br \/>\nBhildi Police Station, District : Banaskantha for the offences<br \/>\npunishable under Sections-363, 366, 376, 506(2)and 114 of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>2.\t\tThe<br \/>\nlearned<br \/>\nCounsel for the petitioner submitted that the petitioner is a lady.<br \/>\nEven as per the allegations made in the complaint, she has no direct<br \/>\nrole to play. The only role attributed to the petitioner, in the<br \/>\ncomplaint, is that of being present at the scene of incident, when<br \/>\nthe daughter of the complainant was allegedly taken away, in a<br \/>\nvehicle, by the son of the present petitioner.\n<\/p>\n<p>3.\t\tI<br \/>\nhave perused the contents of the complaint, prima<br \/>\nfacie,<br \/>\nconsidering the role attributed to the petitioner and also the fact<br \/>\nthat the petitioner has no criminal antecedents, it is<br \/>\nordered that in the event of arrest of the petitioner, in connection<br \/>\nwith C.R. No. I-39\/10, filed before Bhildi Police<br \/>\nStation, District : Banaskantha, she shall be<br \/>\nRELEASED on anticipatory bail, upon furnishing  bond of<br \/>\nRs. 10,000\/-(Rupees Ten Thousand) with one surety of<br \/>\nthe like amount, to the satisfaction of the lower Court and subject<br \/>\nto the conditions that she,<\/p>\n<p>[A]\tshall<br \/>\nCOOPERATE with the investigation and make himself<br \/>\navailable for interrogation whenever required;\n<\/p>\n<p>[B]\tshall<br \/>\nremain PRESENT at the concerned Police Station  on 28th<br \/>\nJanuary, 2011, between 11:00 a.m. to 2:00<br \/>\np.m.;\n<\/p>\n<p>[C]\tshall<br \/>\nNOT hamper the investigation in any manner nor shall<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nwitness so as to dissuade him from disclosing such facts to the Court<br \/>\nor to any Police Officer;\n<\/p>\n<p>[D]\tshall,<br \/>\nat the time of EXECUTION of bond, furnish<br \/>\nthe ADDRESS to the Investigating Officer and the Court<br \/>\nconcerned and shall NOT CHANGE the residence till the<br \/>\nfinal disposal of the case or till further orders;\n<\/p>\n<p>[E]<br \/>\n\tWILL NOT leave INDIA without the prior<br \/>\npermission of the Court and, if is holding a PASSPORT,<br \/>\nshall SURRENDER the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>[F]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nREMAND, if he considers it just and proper and the<br \/>\nconcerned Magistrate would decide it on merits;\n<\/p>\n<p>[G]\tThis<br \/>\norder will be operative if the applicant is arrested, at any time,<br \/>\nwithin a period of 90 days from, TODAY;\n<\/p>\n<p>[H]\tWithin<br \/>\na period of TEN DAYS from the date of arrest, the<br \/>\napplicant shall apply for REGULAR BAIL which<br \/>\napplication shall be decided by the competent Court in accordance<br \/>\nwith law WITHOUT being INFLUENCED by the<br \/>\nfact that anticipatory bail was granted.\n<\/p>\n<p>4.\t\tRule<br \/>\nis made absolute.
