JEEVAN REDDY, J.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  is preferred\tagainst the  judgment of the<br \/>\nCentral Administrative Tribunal (Cuttack Bench) allowing the<br \/>\nOriginal Application  filed by\tthe respondent and directing<br \/>\nthe appellants\t(respondents in the Original Application) to<br \/>\nrelease final  pension and gratuity to the respondent within<br \/>\nninety days of the judgment.\n<\/p>\n<p>     The respondent  was  a  member  of\t the  Indian  Police<br \/>\nService. He  retired on\t December 31, 1990. About six months<br \/>\nprior to  his  retirement,  a  raid  was  conducted  on\t his<br \/>\nresidential  premises.\t On  the   basis  of   the  material<br \/>\nrecovered, a  prosecution has  been launched  against him in<br \/>\nthe Special  Court, Cuttack  under Section  13(2) read\twith<br \/>\nSection 13(1)  of the Prevention of Corruption Act for being<br \/>\nin  possession\tof  assets  disproportionate  to  his  known<br \/>\nsources of  income. [According\tto Section 13(1) of the said<br \/>\nAct, misconduct\t includes  being  in  possession  of  assets<br \/>\ndisproportionate to  his known\tsources of income.] The case<br \/>\nis still  pending. In  view of\tthe  pendency  of  the\tsaid<br \/>\ncriminal case,\tthe appellants\twithheld the gratuity amount<br \/>\nand did not also sanction the pension finally. A provisional<br \/>\npension equal  to ninety  percent of  his  entitlement\twas,<br \/>\nhowever, sanctioned. Aggrieved by the refusal to release the<br \/>\ngratuity amount\t and the  refusal to  sanction\this  pension<br \/>\nfinally, the respondent approached the Tribunal.\n<\/p>\n<p>     The appellants  relied upon  Rule 6  of the  All  India<br \/>\nServices  (Death-cum-Retirement\t Benefits)  Rules,  1958  in<br \/>\nsupport of  their action.  The appellants&#8217;  case was that in<br \/>\nview of\t the pendency  of the  said criminal case, they were<br \/>\njustified in withholding the gratuity amount and also in not<br \/>\nsanctioning the\t pension finally. The Tribunal has held that<br \/>\nthe said  rule does not avail the appellants inasmuch as the<br \/>\ncharge\tagainst\t  the  respondent  is  not  one\t of  causing<br \/>\npecuniary  loss\t to  the  Central  or  State  Government  by<br \/>\nmisconduct or negligence within the meaning of Rule 6(1). We<br \/>\nare of\tthe opinion  that the  reading of  the rule  by\t the<br \/>\nTribunal is  unsustainable and\tincorrect.  The\t rule  reads<br \/>\nthus:\n<\/p>\n<blockquote><p>     &#8220;6.  Recovery from\t pension:-  6(1)  The<br \/>\n     Central Government\t reserves  to  itself<br \/>\n     the right\tof withholding or withdrawing<br \/>\n     a pension\tor any\tpart of\t it,  whether<br \/>\n     permanently or  for a  specified period,<br \/>\n     and the  right of\tordering the recovery<br \/>\n     from pension of the whole or part of any<br \/>\n     pecuniary loss  caused to the Central or<br \/>\n     a State  Government, if the pensioner is<br \/>\n     found  in\ta  departmental\t or  judicial<br \/>\n     proceedings to have been guilty of grave<br \/>\n     misconduct or  to have  caused pecuniary<br \/>\n     loss  to\tthe  Central   or   a\tState<br \/>\n     Government by  misconduct or negligence,<br \/>\n     during his\t service,  including  service<br \/>\n     rendered\t or    re-employment\tafter<br \/>\n     retirement.\n<\/p><\/blockquote>\n<blockquote><p>\t  Provided that\t no such  order shall<br \/>\n     be passed\twithout consulting  the Union<br \/>\n     Public Service Commission:&#8211;<br \/>\n     Provided further that&#8211;\n<\/p><\/blockquote>\n<blockquote><p>     (a)  such\tdepartmental  proceeding,  if<br \/>\n     instituted while  the pensioner  was  in<br \/>\n     service, whether  before his  retirement<br \/>\n     or\t during\t  his  re-employment,  shall,<br \/>\n     after  the\t  final\t retirement   of  the<br \/>\n     pensioner, be  deemed to be a proceeding<br \/>\n     under  this   sub-rule  and   shall   be<br \/>\n     continued and concluded by the authority<br \/>\n     by which  it was  commenced in  the same<br \/>\n     manner as if the pensioner had continued<br \/>\n     in service;\n<\/p><\/blockquote>\n<blockquote><p>     (b)  [Omitted as unnecessary]\n<\/p><\/blockquote>\n<blockquote><p>     (c)  [Omitted as unnecessary]<br \/>\n     Explanation.- For\tthe purpose  of\t this<br \/>\n     rule:-\n<\/p><\/blockquote>\n<blockquote><p>     (a)  a departmental  proceeding shall be<br \/>\n     deemed  to\t  be  instituted   which  the<br \/>\n     charges framed against the pensioner are<br \/>\n     issued to\this or, if he has been placed<br \/>\n     under suspension  from an\tearlier date,<br \/>\n     on such date and\n<\/p><\/blockquote>\n<blockquote><p>     (b)  a  judicial\tproceeding  shall  be<br \/>\n     deemed to be instituted&#8211;\n<\/p><\/blockquote>\n<blockquote><p>\t  (i)  in  the\t case\tof   criminal<br \/>\n\t  proceedings, on the date on which a<br \/>\n\t  complaint is made or a charge-sheet<br \/>\n\t  is  submitted,   to  the   criminal<br \/>\n\t  court; and\n<\/p><\/blockquote>\n<blockquote><p>\t  (ii) in   the\t   case\t  of\tcivil<br \/>\n\t  proceedings, on  the date  on which<br \/>\n\t  the plaint  is presented or, as the<br \/>\n\t  case\tmay  be,  an  application  is<br \/>\n\t  made, to a civil court.\n<\/p><\/blockquote>\n<blockquote><p>     (2)  Where any  departmental or judicial<br \/>\n     proceeding is  instituted under sub-rule<br \/>\n     (1), or  where a departmental proceeding<br \/>\n     is continued  under clause\t (a)  of  the<br \/>\n     proviso thereto  against an  officer who<br \/>\n     has retired  on  attaining\t the  age  of<br \/>\n     compulsory retirement  or otherwise,  he<br \/>\n     shall be  sanctioned by  the  Government<br \/>\n     which   instituted\t  such\t proceedings,<br \/>\n     during the\t period commencing  from  the<br \/>\n     date of  his retirement  to the  date on<br \/>\n     which,   upon    conclusion   of\t such<br \/>\n     proceeding final  orders are  passed,  a<br \/>\n     provisional pension  not  exceeding  the<br \/>\n     maximum pension  which would  have\t been<br \/>\n     admissible\t  on   the   basis   of\t  his<br \/>\n     qualifying\t service  upto\tthe  date  of<br \/>\n     retirement,   or\tif   he\t  was\tunder<br \/>\n     suspension on  the date  of  retirement,<br \/>\n     upto the  date immediately preceding the<br \/>\n     date  on\twhich  he  was\tplaced\tunder<br \/>\n     suspension; but  no gratuity  or  death-<br \/>\n     cum-retirement gratuity shall be paid to<br \/>\n     him  until\t  the  conclusion   of\t such<br \/>\n     proceedings  and\tthe  issue  of\tfinal<br \/>\n     orders thereon.\n<\/p><\/blockquote>\n<blockquote><p>\t  Provided  that  where\t disciplinary<br \/>\n     proceeding has been instituted against a<br \/>\n     member  of\t  the  Service\t before\t  his<br \/>\n     retirement service\t under rule 10 of the<br \/>\n     All  India\t  Service   (Discipline\t  and<br \/>\n     Appeal) Rules, 1969, for imposing any of<br \/>\n     the penalties  specified in  clause (i),\n<\/p><\/blockquote>\n<blockquote><p>     (ii) and (iv) of sub-rule 1 of rule 6 of<br \/>\n     the  said\t rules\tand  continuing\t such<br \/>\n     proceeding under  sub-rule (1)  of\t this<br \/>\n     rule after\t his retirement from service,<br \/>\n     the payment  of gratuity  or  Death-cum-<br \/>\n     Retirement\t  gratuity   shall   not   be<br \/>\n     withheld.\n<\/p><\/blockquote>\n<p>(3)  [Omitted as unnecessary].&#8221;\n<\/p>\n<p>     A reading\tof sub-rule  (1) of  Rule  6  discloses\t the<br \/>\nfollowing features:  (a) if  the pensioner  is\tfound  in  a<br \/>\ndepartmental or\t judicial proceeding  to have been guilty of<br \/>\ngrave misconduct  or (b)  where a  pensioner is\t found in  a<br \/>\ndepartmental or judicial proceeding to have caused pecuniary<br \/>\nloss to the Central or State Government by his misconduct or<br \/>\nnegligence  during   his  service   (including\tthe  service<br \/>\nrendered on re-employment after retirement), (c) the Central<br \/>\nGovernment is  entitled to  withhold or\t withdraw pension or<br \/>\nany part  of it\t whether  permanently  or  for\ta  specified<br \/>\nperiod. The  Central Government\t is also  entitled to  order<br \/>\nrecovery from  pension of the whole or part of any pecuniary<br \/>\nloss caused to the Central or State Government. Sub-rule (2)<br \/>\nsays that (a) where a departmental or judicial proceeding is<br \/>\ninstituted under sub-section (1) or (b) where a departmental<br \/>\nproceeding is  continued under\tclause (a) of the proviso to<br \/>\nsub-rule (1),  (c) such\t employee shall be sanctioned by the<br \/>\ngovernment which  instituted such  proceedings a provisional<br \/>\npension not  exceeding the maximum pension admissible to him<br \/>\nduring the period of pendency of such proceeding, (d) but no<br \/>\ngratuity or  death-cum-retirement gratuity  shall be paid to<br \/>\nhim  until  the\t conclusion  of\t such  proceedings  and\t the<br \/>\nissuance of final orders thereon.\n<\/p>\n<p>     It is  thus clear from an analysis of sub-rules (1) and<br \/>\n(2) that  where a  judicial proceeding\tis pending against a<br \/>\npensioner for  grave misconduct,  the government is entitled<br \/>\nto withhold gratuity amount and\/or death-cum-gratuity amount<br \/>\nand is also entitled to sanction provisional pension for the<br \/>\nperiod of  pendency of\tthe  said  proceedings.\t It  is\t not<br \/>\nnecessary that\ta judicial  proceeding should  relate to the<br \/>\ncharge of  causing pecuniary  loss to  the Central  or State<br \/>\nGovernment by  misconduct or  negligence during his service.<br \/>\nSub-rule (1)  of Rule  6 specifies  two grounds\t upon  which<br \/>\naction thereunder  can be  taken. One is where the pensioner<br \/>\nis found  guilty of  grave misconduct and the other is where<br \/>\nhe is found to have caused pecuniary loss to the Central and<br \/>\nState Government  by misconduct\t and negligence\t during\t his<br \/>\nservice. Sub-rule  (2) provides for orders to be made during<br \/>\nthe pendency  of such  proceedings. It may also be mentioned<br \/>\nthat neither  the All  India Service  (Death-cum-Retirement)<br \/>\nRules nor the Pensions Act, General Clauses Act or the Leave<br \/>\nRules [referred\t to in\tRule  2(2)]  define  the  expression<br \/>\n&#8220;misconduct&#8221;.  It   would,  therefore,\t be  reasonable\t and<br \/>\npermissible to\tunderstand the\tsaid expression\t in  Rule  6<br \/>\naforesaid  in  the  manner  defined  in\t the  Prevention  of<br \/>\nCorruption Act.\n<\/p>\n<p>     The Tribunal  was, therefore,  in error in holding that<br \/>\nunless the  charge  expressly  charges\tthe  pensioner\twith<br \/>\ncausing pecuniary loss to Central or State Government by his<br \/>\nnegligence or  misconduct during  his  service,\t the  action<br \/>\nunder sub-rule (2) of Rule 6 cannot be taken.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed and the judgment of<br \/>\nthe Tribunal is set aside.
