No.37723 of 2010\n                       SURENDRA PASWAN, son of Late Upendra Paswan\n                                            Versus\n                                     STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2\/-   29.10.2010               Heard learned Counsel for the petitioner and the<\/p>\n<p>                      State.\n<\/p>\n<p>                               The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 363, 366 (A)\/34 of the Indian Penal<\/p>\n<p>                      Code.\n<\/p>\n<p>                               Considering the only allegation alleged against the<\/p>\n<p>                      petitioner is that he had helped the co-accused, namely,<\/p>\n<p>                      Dharmendra Paswan in kidnapping the victim girl, let the<\/p>\n<p>                      petitioner above named, who is in custody since<\/p>\n<p>                      18.05.2010, be released on bail on furnishing bail bond of<\/p>\n<p>                      Rs.5,000\/- (Five thousand) with two sureties of the like<\/p>\n<p>                      amount each or any other surety to be fixed by the court<\/p>\n<p>                      concerned to the satisfaction of Chief Judicial Magistrate,<\/p>\n<p>                      Khagaria in Khagaria (Gangaur) P.S. Case No. 145 of 2010<\/p>\n<p>                      ( G.R. No. 615 of 2010), subject to the conditions, (i) That<\/p>\n<p>                      one of the bailor will be a close relative of the petitioner<\/p>\n<p>                      who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                      related with the petitioner. The bailor will undertake to<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>            furnish information to the Court about any change in<\/p>\n<p>            address of the petitioner. (ii) That the affidavit shall clearly<\/p>\n<p>            state that the petitioner is not an accused in any other case<\/p>\n<p>            and if he is he shall not be released on bail, (iii) That the<\/p>\n<p>            bailor shall also state on affidavit that he will inform the<\/p>\n<p>            court concerned if the petitioner is implicated in any other<\/p>\n<p>            case of similar nature after his release in the present case<\/p>\n<p>            and thereafter the court below will be at liberty to initiate<\/p>\n<p>            the proceeding for cancellation of bail on ground of misuse,<\/p>\n<p>            (iv) That the petitioner will give an undertaking that he will<\/p>\n<p>            receive the police papers on the given date and be present<\/p>\n<p>            on date fixed for charge and if he fails to do so on two<\/p>\n<p>            given dates and delays the trial in any manner, his bail will<\/p>\n<p>            be liable to be cancelled for reasons of misuse, and (v) That<\/p>\n<p>            the petitioner will be well represented on each date if he<\/p>\n<p>            fails to do so on two consecutive dates, his bail will be<\/p>\n<p>            liable to be cancelled.\n<\/p>\n<\/p>\n<p>                                                    ( Anjana Prakash, J. )<\/p>\n<p>Ashwini\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Surendra Paswan vs State Of Bihar on 29 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
