No.8133\/2010\n31.08.2010\n\n        Shri Prakash Upadhyaya, Advocate for the\napplicant.\n        Shri   R.N.Yadav,    Panel    Lawyer   for   the\nrespondent\/State.<\/pre>\n<p>        Heard both the parties.\n<\/p>\n<p>        Case diary of Complaint\/Crime No.113\/2010<br \/>\nregistered at Police Station Semariya District<br \/>\nRewa for the offence under Section 306 of IPC is<br \/>\nperused.\n<\/p>\n<p>        The applicant is apprehending his arrest in<br \/>\nthe aforesaid crime.\n<\/p>\n<p>        Learned counsel for the applicant submits<br \/>\nthat the deceased was not the relative to the<br \/>\napplicant      and,    therefore,   presumption   under<br \/>\nSection 113-A of the Evidence Act is not available<br \/>\nto the prosecution. It is alleged that the applicant<br \/>\ndid not provide medicine to the deceased and,<br \/>\ntherefore, she committed suicide. The overt-act of<br \/>\nthe applicant does not come under the purview of<br \/>\ningredients of Section 107 of IPC and, therefore,<br \/>\nno offence under Section 306 of IPC is made out<br \/>\nagainst the applicant. The applicant is a reputed<br \/>\ncitizen of the locality, who has no criminal past<br \/>\nalleged against him. The police is unnecessarily<br \/>\nharassing him, therefore he prays for anticipatory<br \/>\nbail.\n<\/p>\n<p>            Learned Panel Lawyer for the State opposes<br \/>\n      the application.\n<\/p>\n<p>           Keeping in view the submissions made by<br \/>\n      learned counsel for the parties and the facts and<br \/>\n      circumstances of the case, I am of the view that<br \/>\n      this is a fit case for grant anticipatory bail to the<br \/>\n      applicant. Consequently, this application under<br \/>\n      Section 438, Cr.P.C. is hereby allowed. It is<br \/>\n      directed that in the event of arrest, applicant<br \/>\n      Nagbhusan Tiwari shall be released on bail on<br \/>\n      furnishing   a     personal   bond   in   the    sum    of<br \/>\n      Rs.30,000\/- (Rupees thirty thousand) with a solvent<br \/>\n      surety in the like amount to the satisfaction of the<br \/>\n      Arresting Authority.\n<\/p>\n<p>           The applicant shall further abide by the<br \/>\n      conditions   enumerated       in   sub-Section   (2)    of<br \/>\n      Section 438 of Cr.P.C.\n<\/p>\n<p>           This order shall remain in force for a period of<br \/>\n      30 days and in the meanwhile, if the applicant so<br \/>\n      desires, may move an application for regular bail<br \/>\n      before the competent Court.\n<\/p>\n<p>           C.C. as per rules.\n<\/p>\n<p>                                                (N.K.Gupta)<br \/>\n                                                   Judge<br \/>\nAnsari.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Nagbhusan Tiwari vs The State Of Madhya Pradesh on 31 August, 2010 M.Cr.C.
